Zoning bylaw 174-17 (article 5-- non-conforming buildings & uses) states in part; <br /> "Lawfully created structures or uses may be continued, although not conforming with the <br /> provisions of the chapter. Nonconforming single or two family dwelling structures may be <br /> changed, extended or altered if such change, extension or alteration complies with dimensional <br /> requirements applicable to the lot undercurrent provisions of174-31 or for lots which have been <br /> developed pursuant to 174-21, complies with such requirements as were applicable to initial <br /> construction of the dwelling under provisions of 174-21". <br /> This bylaw goes on to say in part; <br /> "Changes, extensions, or alterations of non-conforming single or two family dwelling structures <br /> .... May not be made unless there is a written finding by the Board of Appeals that such change, <br /> extension or alteration shall not be substantially more detrimental that the existing <br /> nonconforming structure....." <br /> According to the literal interpretation of zoning by-law 174-17 (Pat Costello agrees) you must <br /> keep some part of the dwelling structure to be able to use 174-17 as a way to Raze and <br /> replace a structure. When you completely raze a dwelling structure,you fall into the category <br /> of 174-28. <br /> Zoning by-law 174-28 (article V11—Land Space Requirements) states in part; <br /> "No building or structure shall be built nor shall any existing building or structure be enlarged <br /> or altered except in conformance with the regulation of the zoning bylaw as to lot coverage, lot <br /> area, land area per dwelling unit, lot width,front, side and rear yards and maximum height of <br /> structures in the several districts as set forth below except as may otherwise be provided <br /> elsewhere in this zoning bylaw." <br />
