Board of Appeals Minutes - September 23, 1998 6. <br /> Brickyard marketplace Nominee Trust -Requests a Special Permit under Sections 174- <br /> 25.D.1, 174-25.E.1, 174-25.E.2, 174-25.E.4 and 174-25.H,6 of the Zoning By-laws for <br /> use for retail businesses on properties located in C-2 and R-5 zoning districts at 93 Old <br /> Brickyard Road (Map 72, Block 22) and 439 Nathan Ellis Highway(Map 72,Block 23) <br /> Mashpee, MA, (Owner of record; Henry C. Labute). <br /> Members sitting: James E. Regan 111, James M. Dorgan and Robert G. Nelson. <br /> Michael Grotzke of the Phoenix Group represented the applicant with revised plans that <br /> will be submitted for approval from the Design Review Committee on October 14, 1998. <br /> He stated that requests brought up at the August 12, 1998 Board of Appeals meeting have <br /> been included in the revised plans, Some of the requests included: <br /> !< + left-hand turn only signs at the exits. <br /> • septic system moved to the front of the lot. <br /> • widen and repave the road back to service entrance of the lot. <br /> • lighting concentrated on the front of the property. <br /> • wooden fence to provide screening. <br /> • remove H-6 zoning. <br /> Mr. Regan reminded Mr. Grotzke that a 7-foot fence was requested. He also addressed <br /> the issue of"no parking" signs. Mr. Grotzke informed the Board that the Police Chief <br /> was consulted and he stated that the abutters must petition the Board of Selectmen for"no <br /> parking signs"to be installed, The Board of Selectmen will then submit the petition to the <br /> Police Department. Mr. Grotzke clarified that berm will be installed. <br /> Mr. Nelson stated that the plan submitted is incorrect according to Land Court Plan <br /> 11380N, dated October 12, 1967. He reminded Mr. Grotzke the Board secretary had <br /> advised him of the discrepancy that affects the dimensioning of the plan. Mr, Grotzke told <br /> the Board secretary to call the surveyor, which she did. However, the correction was not <br /> made. <br /> Comments from, an abutter, Mr. Labute indicated that he is satisfied with the changes. <br /> Mr. Shute, an abutter, claimed that traffic in the neighborhoods will increase if the roads <br /> are improved. The owners, Mr. and Mrs. Berish, expressed concern that repaving the <br /> entire road will put an undue and unfair burden on them. He stated that the proposal is a <br /> relatively small project compared to a large shopping center. <br /> jMr. Hauck stated that Design Review has not received any landscaping plans, which are <br /> j required two weeks in advance of the meeting.
