Board of Appeals Minutes -November 12, 1997 2. <br /> Maxwell Gates - Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the setback requirements in an R-3 zoning district on property located <br /> at 18 Waterline Drive North (Map 120, Block 177)Mashpee, MA. The applicant requests <br /> a variance of.9 feet for an existing garage which is located 14,1 feet from the North side <br /> line and a variance of 13 feet in the rear to allow a setback of 7 feet from a proposed deck <br /> addition. <br /> Members sitting: E. Govoni, J, Regan, C. Hawver <br /> Engineer John Slavinsky represented the applicant and informed the Board than an <br /> existing garage was built 14.1 feet from the side lot line and the Building Inspector <br /> suggested that the records be corrected by obtaining a Variance of.9 feet for this <br /> structure. The owner also requests a variance to allow a deck extension in the rear which <br /> would result in a 7 foot setback. He explained that Conservation has approved the plans <br /> Mr. Regan moved to grant the Variance of 13 feet in the rear setback and .9 feet for the <br /> garage, Ms. Hawver seconded. All agreed. <br /> Maxwell Gates-Requests a Special Permit under Section 174-17 of the Zoning By-laws <br /> for the expansion of an existing non-conforming structure with a 16 foot by 18 foot house <br /> addition and expansion of a rear deck on property located in an R-3 zoning district at 18 <br /> Waterline Drive North(Map 124, Block 177)Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Mr. Regan moved to grant the Special Permit. Ms. Hawver seconded. All agreed, <br /> Stephen Kyros -Mr. Hauck distributed a memo regarding the landscaping at Honeydew <br /> Donuts. Mr. Govoni said they were supposed to come back to Design Review, Mr. <br /> Hauck reviewed the approved landscape plan and the failure to follow the number of <br /> shrubs and trees required by the plan, Mr. Govoni said they should follow the original <br /> plan and that a letter be sent informing Mr. Kyros of this and to meet with Design Review. <br /> i ' <br /> Minutes -Mr. Govoni moved to accept Minutes of September 24 and October 22, 1997 <br /> as amended. <br /> i <br /> Deer Crossing landscape bond - Mr. Nelson reviewed the site conditions and the number <br /> of plants. Mr. Govoni moved to release the bond. Mr. Regan seconded. All agreed. <br /> Dunkin' Donuts - The Board reviewed the RFP proposal. Mr. Govoni said that the focus <br /> !' of the RFP has been changed to ask for a safety study. The Board reviewed and edited <br /> the RFP. <br /> Elinor Walsh <br />
