TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> April 23, 1997 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, April 23, 1997 at 7:30 <br /> PM, at the Mashpee Town Hall. Board Members present were: Edward M. Govoni, <br /> Chairman; Cheryl A Hawver, Clerk and Associate Members Robert G. Nelson, Richard T. <br /> Guerrera, James M. Dorgan and Michael A, Makunas, Building Inspector William F. <br /> Hauck was in attendance. Vice-Chairman James E. Regan III was absent. <br /> Dunkin' Donuts- Mr. Govoni stated that the Board had received a request to continue <br /> this hearing to May 14, 1997. <br /> Paul Tibets -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the front setback and lot coverage requirements to allow the addition <br /> of a 12' x 16' deck on property located in an R-3 zoning district at 123 OId Brickyard <br /> Road (Map 72, Block 18) Mashpee, M.A. (Owner of record: Leann B. Tibets). <br /> Members sitting: E. Govoni, C. Hawver, M. Makunas <br /> Mr. Tibets informed the Board that his house was built before zoning and he wanted to <br /> add a deck which would result in an 11 '/s foot setback from Sakonnet Drive, Mr. Govoni <br /> questioned if a Variance was needed for the setbacks since the parcel predated zoning. <br /> Mr. Makunas suggested a Letter of Determination. Mr. Govoni moved to vote that a <br /> Variance was not necessary for the setback, Mr. Makunas seconded. All agreed. <br /> Gregozy J. and Carol H. Yurek -Request a Variance from Section 174.25.1.9 of the <br /> Zoning By-laws for permission to exceed the 70' dock length limit to allow a dock length <br /> of 96' on property located in an R-3 zoning district at 199 Daniel's Island Road (Map <br /> 100, Block 35)Mashpee, MA. A 1995 Variance granted for the same relief has expired. <br /> Members sitting: E. Govoni, R. Nelson, C. Hawver <br /> Engineer Michael Grotzke informed the Board that the Variance has expired due to the <br /> time it has taken to secure all of the other Permits. Ms. Hawver moved to grant the <br /> Variance from 174-25.I.9 to allow a dock length of 96 feet and quoted findings from the <br /> V-95-16 Decision, Mr, Nelson seconded. All agreed. <br />
