MASHPEE BOARD OF APPEALS <br /> Minutes <br /> Wednesday, February 26, 1997 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, February 26, 1997 at 7:30 <br /> P.M. at the Mashpee Town HaII. Board Members present were Edward M. Govoni, <br /> Chairman; James E. Regan III, Vice-Chairman; Cheryl A. Hawver, Clerk and Associate <br /> Members Richard T. Guerrera and Michael A. Makunas. Associate Members Robert G. <br /> Nelson and James M. Dorgan were absent. Asst. Building Inspector Russell Wheeler was <br /> in attendance. <br /> Town of MashDee - Harbormaster's Facilities -Requests a Variance from Sections 174-31 <br /> and 174-32 of the Zoning By-laws for permission to vary the front and side setback <br /> requirements and allow access from an unpaved road to a proposed Harbormaster's <br /> Building to be constructed on property located in an R-3 zoning district at 88 Seconsett <br /> Island Road (Map 119, Block 100)Mashpee, MA. <br /> Members sitting: J, Regan, C. Hawver, M. Makunas <br /> E. Govoni stepped down for this hearing since he is an Assistant Harbormaster. Engineer <br /> David Sanicki represented the applicant. He explained that the variances were necessary <br /> to locate the building away from the wetland areas of a small lot. The building is not a <br /> public facility and will be used by the Harbormaster and Shellfish Warden only. Mr. <br /> Sanicki explained that lot coverage is 20%. Perry Ellis, Harbormaster, said the structure is <br /> more of a garage and workshop and he will still maintain an office at the D.P.W. building. <br /> Conservation has approved the plans. <br /> Mr. Makunas moved to grant a Variance of 10 feet to allow a S foot sideline setback on <br /> the Northwest side and a Variance of 4 feet to allow a front setback of 36 feet. Ms. <br /> Hawver seconded. All agreed. <br /> Irene Real Trust -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the minimum lot frontage requirements in a cluster subdivision to allow <br /> construction of a single family dwelling on property located in an R-3 zoning district at 24 <br /> East Way(Map 89, Block 76) Mashpee, MA. (Owner of record: Midtown Realty Co.) <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Mr, Regan announced that this was a Chapter 112 hearing since taxes are due on the <br /> property. Engineer John Slavinsky represented the applicant and explained that the <br /> subject lot ran from East Way to River Road but that the owner wanted the house to have <br /> access from East Way which is paved, The lot has 20' frontage on East Way but requires <br /> 60' on a curve. The lot is part of the Sandalwood cluster development and the proposed <br /> house location meets all of the zoning requirements on setbacks.
