BOARD OF APPEALS <br /> Minutes <br /> Wednesday, January 8, 1997 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, January 8, 1997 at 7:30 <br /> P.M. at the Carol H. Jacobson Senior Center. Board members present and acting <br /> throughout were: Edward M. Govoni, Chairman; James E. Regan III, Vice-Chairman, <br /> and Associate Members Robert G. Nelson,Richard T. Guerrera, James M. Dorgan and <br /> Michael A. Makunas. Cheryl A, Hawver, Clerk, was absent. William F. Hauck,Building <br /> Inspector; Russell Wheeler, Assistant Building Inspector and Deputy Fire Chief Sheldon <br /> Hamblin were present. <br /> Deer Crossing Associates -World G - Request a Special Permit under Sections 174- <br /> 17 and 174-25.B,14 to allow the expansion of Building C at Deer Crossing with a 1,200 <br /> square foot addition to the second floor of the World Gym. The property is located in a <br /> C-1 zoning district at 681 Falmouth Road (Map 81, Block 32)Mashpee,MA. <br /> Members sitting: E. Govoni, J. Regan, M. Makunas <br /> Attorney Robert Mills represented the applicant and reviewed plans for the addition of a <br /> second story on a portion of the building. He said the building was built without a <br /> building permit and this was an extension of a non-conforming use. He said the use <br /> requires an additional 5 parking spaces and that the complex has 302 spaces with 270 <br /> required. He explained that the 1,200 square foot addition would be used as an aerobics <br /> center and that the Deputy Fire Chief had requested a sprinkler system. Mr. Govoni <br /> stated that the addition would not encroach on the current parking areas. Mr. Dorgan <br /> ! questioned the parking spaces and Mr. Govoni asked if there was enough parking at the <br /> upper level. Mr. Cappozolli, the owner, said people would park at the lower level and <br /> walk up to the entrance. There was discussion of the signage and Mr. Mills said the large <br /> sign at the top of the building would be removed. <br /> Sally Bold, a trustee of the Deer Crossing Condominium Trust, said that the Trust has a <br /> court case pending against Mr, Cappozolli and that he has built a volleyball court and <br /> tennis court on Deer Crossing Trust property. She requested that the Board delay any <br /> action until the court case has been resolved. Arthur Weinstein of the Deer Crossing <br /> Trust also said that parking was a problem and that the aerobics class was presently held <br /> on the lower level and that all of the parking was there. He said there was not enough <br /> parking at the upper level. Attorney Mills said there had been a previous lawsuit which <br /> was dismissed by the courts. Mr. Regan and Mr. Dorgan asked for more information on <br /> the parking at the upper level. <br />
