McDonald -Requests a Special Permit under Section 174-25,A.8 for an <br /> f existing in-law apartment in a single family home on property located in an R-5 zoning <br /> r district at 31 Cambridge Drive (Map 16, Block 43)Mashpee,MA. <br /> Members sitting: E. Govoni, J. Regan,R. Guerrera <br /> Attorney Robert Mills represented the applicant and explained that the applicant had filed <br /> under Section 174-25.A.8 which allowed for an apartment. He said the apartment did not <br /> meet the criteria of this by-law in that it was less than 750 square feet and asked to amend <br /> the application to file under 174-17 for the expansion of a non-conforming dwelling. Mr. <br /> Mills said the apartment has existed for ten years and is protected by Chapter 40A, <br /> Section 7. <br /> Mr. Makunas stated that it was an illegal non-conforming two family house which has <br /> existed for ten years and questioned why the application before the Board. Mr. Mills said <br /> it has been assessed as a two family home. Mr. Govoni asked that Mr. Hauck research the <br /> building permit for the addition or that affidavits be submitted from neighbors. <br /> Mr. Govoni moved to continue the hearing to February 12. Mr. Regan seconded. All <br /> agreed <br /> Cynthia Ann Roach -Requests a Special Permit under Sections 174-17, 174-20, 174-31 <br /> and 174-32 to allow the replacement of a pre-existing non-conforming dwelling and shed <br /> with a new single family dwelling to be constructed on an unpaved road. The site is <br /> located in an R-5 zoning district at 64 Lake Avenue (Map 30,Block 58) Mashpee, MA. <br /> Members sitting: E. Govoni, R. Guerrera,M. Makunas <br /> Randy Swetish, Builder, represented the applicant. and explained that Ms. Roach planned <br /> to build a new house, move shed from property line and install a new septic system. He <br /> explained that the property is located on an unpaved road. He said the house location was <br /> not firm and Mr. Govoni explained that the Board would require an accurate plan. Mr. <br /> Hauck said he required a minimum of 10 foot setbacks and suggested Mr. Swetish take <br /> the original plans to his engineer to change the location of the house. He said the Board <br /> of Health would also require revised plan. Deputy Chief Hamblin questioned the road <br /> and said he would review the site, <br /> Mr. Govoni moved to take the application under advisement until January 22, 1997.
