TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Minutes - Wednesday, October 23, 1996 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, October 23, 1996 at 7:30 <br /> P.M. at the Carol H. Jacobson Senior Center. Board Members present and acting <br /> throughout were Edward M. Govoni, Chairman; James E. Regan III, Vice-Chairman; <br /> Cheryl A. Hawver, Clerk, and Associate Members Robert G. Nelson, Richard T. Guerrera <br /> and James M. Dorgan. Building Inspector William F. Hauck and Assistant Building <br /> Inspector Russell Wheeler were in attendance. <br /> Paul E. and Ann T. Keon -Request a Special Permit under Section 174-17 of the Zoning <br /> By-laws to allow the replacement of a pre-existing non-conforming dwelling with a new <br /> single family dwelling on property located in an R-3 zoning district at 136 Captain's Row <br /> (Map 96, Block 22) Mashpee, MA, <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Engineer Jack Landers-Cauley represented the applicant and explained that the owner <br /> wishes to demolish an existing seasonal cottage and replace it with a new year-round <br /> house with a garage. He stated that the new structure will comply with the zoning setback <br /> requirements and comply with the Title V septic regulations and that it has been approved <br /> by the Conservation Commission. Mr. Landers-Cauley explained that the owner plans a <br /> four bedroom house and will be required to install a denitrification septic system. Mr. <br /> Regan asked about a shed which was encroaching on the lot line, Mrs. Keon explained it <br /> was on property owned by her sister. No comments were received from abutters. <br /> Mr. Regan moved to grant the Special Permit. Mr. Govoni seconded and stated that the <br /> Goldhirsh v. McNear case allowed the expansion of a non-conforming structure if it is not <br /> more detrimental to the neighborhood. Ms. Hawver seconded. All agreed. <br /> Plymouth Savings Bank- (Agent: Amidon & Co., Inc.) -Requests a Special Permit under <br /> Sections 174-51.1) and 174-55.13 of the Zoning By-laws to allow one sign affixed to the <br /> building to exceed 20 square feet. The proposed sign is 28 square feet. The property is <br /> located in a C-1 zoning district at 675 Falmouth Road (Map 81, Block 36) Mashpee, MA. <br /> Plymouth Savings Bank <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Doug Amidon represented the Bank and explained that the sign will be placed on the gable <br /> end of the bank. He said it would be a 28 square foot carved wood sign and had been <br /> approved by Design Review, <br /> Ann Tanney, a resident of Deer Crossing Condominiums, asked about size of sign and <br /> Mary McCormack, a resident of Deer Crossing, expressed concern on the size of the signs <br /> at the Italian Market and at the Tru Value hardware store. Mr. Govoni explained that the <br />
