(No response) All right. <br /> The Chairman: I 'm going to make a Motion that we deny the <br /> Appeal for the following reasons: <br /> 1 . I move that we uphold the Building Inspector' s Decision <br /> not to rescind the Modification Agreement for the reason that the <br /> Building Inspector has no authority to rescind the Modification <br /> Agreement. The Town' s right to enforce restrictions on the New <br /> Seabury land is an interest in land and that it may only be <br /> modified with an agreement between the Town and the owners of the <br /> land burdened by the restrictions as authorized by the Vote of <br /> the Town Meeting. <br /> 2 . And we uphold the Building Inspector' s Decision not to <br /> revoke any building permit for the reason that no building <br /> permits have been applied for or issued in Section 5, which <br /> depends for their authorization on the increased number of <br /> residential units or the increased commercial floor area <br /> permitted by the Modification Agreement. <br /> -7- <br />
