Board of Appeals Minutes - September 11, 1996 3. <br /> James G. Haidas - (Cooke's Restaurant) -Requests a Special Permit under Sections 174- <br /> 25.E.2, 174-25.H.6, 174-25.I.10, 174-24, 174--52D of the Zoning By-laws for permission <br /> to construct a 170 seat restaurant with some outdoor dining on property located in a C-1 <br /> zoning district at 7 Ryan's Way (Map 67, Block 74) Mashpee, MA. (Owner of record: <br /> Gary T. Melia). (Advisement from August 28, 1996). <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Mr. Govoni moved to grant the Variance and explained that Town Meeting will have a <br /> zoning article in October eliminating this access restriction. He explained that the lack of <br /> legal access is a hardship that affects this site since no access is allowed to Great Neck <br /> Road North. He moved to grant a Variance of 25 feet to allow 175 feet between the <br /> driveway to the proposed restaurant and Great Neck Road North, a variance of 104 feet <br /> to allow a distance of 96 feet between the driveway to the proposed restaurant and the <br /> entrance to Sandpiper Village, Mr. Nelson measured plans and confirmed above <br /> measurements. Mr, Regan seconded. All agreed. <br /> Mr. Govoni said that due to the concerns of the abutters he would prefer to defer the <br /> permit for outdoor dining until a later date when the applicant could file a separate <br /> application for accessory use. He moved to grant the Special Permit for the restaurant <br /> without the outdoor dining. He reviewed findings that there was sufficient land and it has <br /> been zoned for business since earliest zoning in Mashpee. Mr. Regan seconded. All <br /> agreed. Mr. Govoni conditioned the permit with the posting of $10,000 landscape bond. <br /> Myer Singer, attorney for Mr. Haidas, requested that the Variance include a dimension <br /> across Ryan's Way from the 99 Restaurant, Mr. Regan moved to grant a variance of 150 <br /> feet to allow a distance of 50 feet between the driveway to the proposed restaurant and <br /> the entrance to the 99 restaurant across Ryan's Way. <br /> Harry T. Spohr- The Board received a request for a six month extension of Variance 95- <br /> 60. Mr. Govoni moved to grant the six month extension. Mr. Regan seconded. Ms. <br /> Hawver agreed. <br /> Discussion - The Board discussed proposed changes in the Coastal Resources <br /> Management Committee. <br /> Mr. Govoni moved to adjourn at 9:10 P.M. Mr. Regan seconded. All agreed. <br /> Elinor Walsh <br />
