Board of Appeals Minutes - August 28, 1996 3. <br /> Mashpee Water District - has Appealed the Decision of the Building Inspector denying a <br /> request for zoning enforcement pursuant to M.G.L. Ch. 40A, Section 7, The District had <br /> requested that permits issued to New Seabury under the Modification Agreement of May <br /> 22, 1995, between the Town of Mashpee and New Seabury Operations Nominee Trust be <br /> revoked and that the Modification Agreement itself be rescinded or that the Board <br /> determine that Zoning Board of Appeals action is necessary. The subject property is <br /> known as Section 5 of the New Seabury Cluster Development and is located at 155 and <br /> 163 Rock Landing Road, (Map 116, Blocks 70 and 70A), 70 Cross Road (Map 116-74). <br /> (Owner of record: Christopher Burden TR. N.S. Operations Nominee Trust) and 24 Mall <br /> Way (Map 116, Block 69) (Owner of record: Christopher Burden), <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> (See separate Minutes) <br /> Mashpee Industrial Park Park Realty Trust - Requests a Special Permit under Sections 174- <br /> 25.1).1-5, 174-25.G.1-10, and 174-25.H.6 of the Zoning By-laws for permission to <br /> construct a 80' by 124.11' building to be divided into a maximum number of five <br /> commercial rental units on property located in an I-1 zoning district at 64 Industrial Drive <br /> (Map 88, Block 34) Mashpee, MA. (Owner of record: Paul deRuyter, TR.). <br /> Members present: E, Govoni, J. Regan, C. Hawver, R. Nelson, R. Guerrera <br /> Bill Currie represented the applicant and informed the Board that he was planning to <br /> construct a steel building under 10,000 square feet to be divided into 5 rental units. He <br /> explained that he had met with the Design Review Committee and they had requested <br /> changes in drainage and a landscape plan. He said he hoped to attract small business, <br /> Mr. Govoni read into the record a letter from Attorney Edward W. Kirk opposing the <br /> application (attached). He also read a memo from the Town Planner suggesting improved <br /> design and landscaping, minutes of the Design Review meeting and a memo from the <br /> Director of Public Works in favor the application. <br /> Wayne Duchemin, Mashpee Director of Economic Development, said the Town was <br /> working closely with the owners of the Industrial Park to help develop the lots. Mr. <br /> Govoni said the Board would need the final landscape and parking plans. There was <br /> discussion that the application had included too many uses and Mr. Nelson said it included <br /> 16 different uses, Mr. Currie said they had no potential tenants and would like to attract <br /> tradesmen. Mr. Hauck said this was the standard method of procedure and once the <br /> building has a permitted use he can approve it. Mr. Currie said they were trying to avoid <br /> having to repeat the Special Permit process for each tenant. Mr. Nelson said one of the <br /> requested uses was for a trucking terminal and this would require entirely different <br /> landscaping. Mr. Govoni said the permit should be restricted to certain uses. Ms. Hawver <br /> asked that Mr. Currie determine the exact categories of uses. <br /> Mr. Govoni moved to continue to September 25. Ms. Hawver seconded. All agreed. <br />
