Jacobson Senior <br /> Center, 500 Great Neck Road North, Mashpee, Massachusetts at <br /> 8 :45 p.m. on Wednesday, August 28, 1996 by the Chairman, <br /> Edward M. Govoni . <br /> Board of Appeals Members present: Edward M. Govoni, <br /> Chairman; James E. Regan III, Vice Chairman; Cheryl A. Hawver, <br /> Clerk; Associate Members Richard T. Guerrera and Robert G. <br /> Nelson. <br /> Also present: William F. Hauck, Building Inspector; Jeanne <br /> S . McKnight, Town Counsel-Kopelman and Paige. <br /> The Chairman recognized Cheryl A. Hawver, Clerk, for the <br /> purpose of reading Notice of Public Hearing in this matter. <br /> Ms . Hawver: Mashpee Water District has Appealed the <br /> Decision of the Building Inspector denying a request for zoning <br /> enforcement pursuant to M.G. L. C.40A, S7 . The District has <br /> requested that permits issued to New Seabury under the <br /> Modification Agreement of May 22, 1995 between the Town of <br /> Mashpee and New Seabury Operations Nominee Trust be revoked and <br /> that the Modification Agreement itself be rescinded or that the <br /> Board determine that Zoning Board of Appeals action is necessary. <br /> The subject property is known as Section 5 of the New Seabury <br /> Cluster Development and is located at 155 and 163 Rock Landing <br /> Road, (Map 116, Blocks 70 and 70A) , 70 Cross Road (Map 116-74) <br /> Owner of record, Christopher Burden, Trustee New Seabury <br /> operations Nominee Trust and 24 Mall Way Map 116, Block <br /> 69, owner of record, Christopher Burden. <br /> The Chairman inquired as to representation for the water <br /> District and recognized Russell Babcock, <br /> Mr. Babcock introduced himself for the record as Russell <br /> Babcock, Chairman of the Mashpee Water District : And I will <br /> address you just briefly before I turn it over to our counsel <br /> who will protect our area of interest . <br /> Now this is a little different kind of a case that comes <br /> before you, it concerns our public water supply. The changes <br /> which are contemplated would increase the number of dwellings <br /> from twenty-five (25) to four hundred and twenty-five (425) ; and <br /> the commercial space from a hundred and eighty thousand <br /> (180, 000) square feet to three hundred and forty thousand <br /> (340, 000) square feet . <br />
