Board of Appeals Minutes -May 8, 1996 2. <br /> F. Keats and Ina C. Boyd -Request a Variance from Section 174-31 of the Zoning By- <br /> laws for permission to vary the side line setback requirements to allow the addition of a <br /> breezeway and garage on property located in an R-3 zoning district at 12 Bright Coves <br /> Way(Map 111, Block 43)Mashpee,MA. <br /> Members sitting: E. Govoni, J. Regan,K, Marsters <br /> Engineer Michael Grotzke represented the applicant and explained that the applicant <br /> planned to add a breezeway and garage to a home that was located outside of the New <br /> Seabury Special Permit. He stated that the lot was created in 1961 in an R-75 zoning <br /> district requiring 7 112 foot side setbacks. The applicant requires a 5.6 foot setback. The <br /> lot is impacted by location within the flood plain and need to have 20 foot setback from <br /> the septic system. <br /> Mr. Regan moved to grant the Variance of 1.9 feet to allow a sideline setback of 5.6 feet <br /> The Board found that due to topography of the lot and the impact of the wetlands and the - <br /> 100 foot floodplain there was no other location for the addition. Mr. Govoni seconded <br /> and noted that the proposal was within the 20% lot coverage. <br /> Stephen Berish -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side and rear setback requirements to allow the construction of a <br /> single family house and garage on property located in an R-3 zoning district. The <br /> proposed site is a combination of two lots at 99 Waterline Drive South(Map 125, Block <br /> 249) and 37 Keel Way(Map 120,Block 133)Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, R. Nelson <br /> Engineer Michael Grotzke represented the applicant and informed the Board that the two <br /> lots are impacted by the wetlands. He explained that the Conservation Conunission <br /> wanted the house moved away from the wetlands and letters were received from abutters <br /> in favor of the location of the house. The lot is subject to the Cluster Subdivision setbacks <br /> of 15 feet side and 20 feet rear. The lot will be 77,000 square feet. <br /> Mr. Nelson moved to grant the Variance of 12.5 feet on the North side to allow a sideline <br /> setback of 2.5 feet and a Variance of 8 feet on the West to allow a rear setback of 12 feet. <br /> Mr. Govoni seconded. All agreed. <br /> Michael J. and Andrea L. Yanoff - Continued from January 17, 1996. <br /> Members sitting: E. Govoni, J. Regan,K. Marsters (R.
