Board of Appeals Minutes -February 28, 1996 2. <br /> EIwood O. Mills, Jr. -Requests a Variance from Section 174-32 of the Zoning By-laws <br /> for permission to construct a single family home on an unpaved road on property located <br /> in an R-5 zoning district on Lake Avenue, off Newtown Road in Barnstable. (Map 30, <br /> Block 142 -- formerly in Map 30, Block 59)Mashpee,'MA. <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Mr. Mills represented his application and informed the Board that the length of the <br /> unpaved road is 3/4 of a mile. He explained that his parents had built a home on the 20 <br /> acres of property in 1955 and that his grandparents had used the property from 1945 for <br /> hunting and cranberry farming, He said three dwellings are now located on the property <br /> and he plans to build on an 84,000 sf lot. Mr. Mills has reviewed the land with the fire <br /> department. Mr. Govoni noted that he had visited the site and found the road passable but <br /> that the Variance should be conditioned that the Town would not be responsible for <br /> maintaining the road. Comments were received from the Fire Department asking that the <br /> 911 access be tested. <br /> Mr. Regan moved to grant the Variance with the condition that the owner is responsible <br /> for the maintenance of the road to provide access for emergency vehicles and that the <br /> Town has no responsibility for maintenance. Ms. Hawver seconded. All agreed. <br /> Mark R. Efron -Requests a Special Permit under Section 174-17 of the Zoning By-laws <br /> for permission to expand a pre-existing non-conforming dwelling with a 1,057 square foot <br /> addition in an R-3 zoning district at 358 Monomoscoy Road (Map 120,Block 109) <br /> Mashpee, MA. <br /> Members sitting: E. Govoni, K. Marsters, C. Hawver <br /> Mr. Efron explained that his property has two houses on it and he is planning the <br /> expansion of one of the existing dwellings. Conservation has approved the plans. Jim <br /> Hanks, an abutter, spoke in favor of the application. He said all of the existing structures <br /> were on the lot before zoning in Mashpee. Mr. Hauck said two houses existed. Total lot <br /> coverage would be 10%. <br /> Ms. Hawver moved to grant the Special Permit. Mr. Govoni found that the Title V <br /> upgrade is an improvement to the site and that the structures are pre-existing and non- <br /> conforming. Mr. Govoni seconded. All agreed. <br /> Doe Family Trust/99 West Inc. -Requests a Variance from Sections 174-55.B, C. F. and <br /> G. of the Zoning By-laws for permission to allow internal illumination of signs, exceed the <br /> maximum signboard area and locate a freestanding sign 12' from the lot line on Great <br /> Neck Road North on property located in a C-1 zoning district at 8 Ryan's Way(Map 67, <br /> Block 75) Mashpee, MA. <br />
