TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Minutes <br /> Wednesday, January 17, 1996 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, January 17, 1996 <br /> at 7:30 P.M. at the Mashpee Town Hall. The meeting was a replacement of the scheduled <br /> meeting of January 10, 1996 which was canceled due to a blizzard. Board Members <br /> present and acting throughout were: Edward M.Govoni, Chairman; James E. Regan III, <br /> Clerk and Associate Members Kenneth E. Marsters and Robert G. Nelson. Board <br /> Members absent were John J. Friel and Cheryl A. Hawver. Building Inspector William F. <br /> Hauck was in attendance. <br /> Deer Crossing Associates -Request a Variance from Section 174-31 of the Zoning By- <br /> laws for permission to vary the setback requirements on property located in a C-1 zoning <br /> district at 681 Falmouth Road (Map 81, Block 23)Mashpee, MA. <br /> Deer Crossing Associates-Request a Special Permit under Sections 174-17, 174-24C, <br /> 174-25.D.1, 174-25.D.2, 174-25.E.1, 174-25.E.2 and 17425,.6 of the Zoning By-laws <br /> for permission to expand Building A with a two-story addition of approximately 2,400 <br /> square feet. The proposed addition would be located between the Deer Crossing Market <br /> and Route 28. The property is located in a C-1 zoning district at 681 Falmouth Road <br /> (Map 81, BIock 23) Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, R. Nelson <br /> Attorney Robert Mills represented the applicant and informed the Board that there had <br /> never been a comprehensive Special Permit for the entire Deer Crossing project. He said <br /> that the entire project was being considered for the parking requirements. He explained <br /> that the present addition would be for 1,958 square feet for restaurant, retail and office <br /> use. He stated that this was an expansion of a pre-existing non-conforming use. <br /> He said lot coverage for the entire project was 14.5% and the Building A coverage on the <br /> separated lot would be 11%. Attorney Mills stated that they may need a Variance in the <br /> setback from an access road although this road was pre-existing. Mr. Govoni said that a <br /> Variance was not necessary, Ron Cappozolli, the owner, stated that he wanted to upgrade <br /> the look of the building to conform with the new Building E. Doug Annino, the architect, <br /> reviewed the plans <br /> Mr.Regan moved to grant the Special Permit subject to the posting of a landscape bond in <br /> the amount of$2,500. Mr. Govoni seconded. All agreed. Mr. Govoni moved to grant <br /> the written request to withdraw the application for a Variance. Mr. Regan seconded. All <br /> agreed. <br />
