Bloom Doc. #: 1303055 <br /> 6 Cross Tree Way Ctf. #: 210617 <br /> (Map 112 Parcel 20) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 4, 2016 by Lori and Michael Bloom requesting <br /> a Variance from lot coverage under§174-31,and §174-33 setback from water and wetlands <br /> of the Zoning Bylaws to raze and replace a single-family dwelling on property located in <br /> an R-3 Zoning District, at 6 Cross Tree Way, Map 112 Parcel 20, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 11, 2016 and November 18, <br /> 2016 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2016 at which time the following members of the Board of <br /> Appeals were present; Vice Chairman, William Blaisdell, Board Members, Ron Bonvie, <br /> Dom DeBarros, and Scott Goldstein, and Associate Members, Brad Pittsley and Norman <br /> J, Gould. <br /> Mr. Joe Colasuonno, New Seabury represented the applicants for the raze and <br /> replace project. They propose to tear down two existing structures and rebuild a new home <br /> and pool. He said the project meets the front, side,and rear yard setbacks. The lot coverage <br /> is 19.97%, and the upland lot area is 20,904 sq. ft. The building height is 35 ft. There will <br /> be a new septic system installed. <br /> The Board read the department comments into the record. There were no comments <br /> from the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance and determined that the setbacks were within the required zoning requirements <br /> under Section 174-31, and under Section 174-33. <br /> 1 <br />
