Spinard <br /> requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for extensions <br /> and alterations of a pre-existing non-conforming, single-family dwelling on property <br /> located in an R-3 Zoning District, and Popponesset Overlay District, at 3 Bluff Avenue, <br /> Map 112 Parcel 94, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town.of Mashpee, on November 11, 2016 and November 18, <br /> 2016 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-Iaws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2016 at which time the following members of the Board of <br /> Appeals were present; Vice Chairman, William Blaisdell, Board Members, Ron Bonvie, <br /> Dom DeBarros, and Scott Goldstein, and Associate Members, Brad Pittsley and Norman <br /> J. Gould. <br /> Attorney Mark Gildea represented the homeowner, Mr. Spinard who was also <br /> present. He said that the lot is approximately 7,123 sq. ft. The Spinard's have owned the <br /> property for 16 years, and the accessor's card shows that the structure was built in 1925 <br /> which pre-dates zoning. <br /> The project consists of changing the existing sunroom into a kitchen which is <br /> located in the back of the property situated on Bluff Ave. Attorney Gildea said the non- <br /> conformity, with respect to that part of the structure, is the setback to the lot line. The <br /> second change is that the existing deck will be enclosed at the entrance of the house. There <br /> will be adequate space for parking. <br /> There were no abutters present. <br /> 1 <br />
