Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 3, 2016 and June 10, 2016 a copy of which is attached hereto and made a part hereof. The Mashpce Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. Tesla Motors MA, Inc. has a building permit for an educational gallery showroom occupying a 1,501 square foot space at 11 Central Square, Mashpee Commons, and they would like to apply for a car dealership license. Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, June 22, 2016 at which time the following members of the Board of Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Member, Dom DeBarros, and Associate Members, Brad Pittsley and Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. Attorney Mike Ford, Tom Feronti and John Renz all with Mashpee Commons represented the application for Tesla. The Board had an informal meeting with Mashpee Commons at the hearings on May 25, 2016 to discuss the possibility of Tesla becoming a licensed car dealership. Tesla is currently permitted and occupying a unit located at 11 Central Square as a show room gallery only. Mr.Ford said he reviewed the Zoning Bylaws and discovered that a Special Permit for"use"is required for Tesla to become an actual car dealership. The 1986 Special Permit (SP-86-04-024) specifically states that modifications need to be brought to the Zoning Board of Appeals. He said that Tesla has applied for their Class 1 License and will be meeting with the Selectmen on July 11, 2016. 1
