Badway and Leslie M. Averna Bk#: 27154 <br /> 14 Aries Lane Page#: 321 <br /> (Map 93 Parcel 29) <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 11, 2016 by Owners, Thomas G. Badway and Leslie <br /> M. Averna requesting a Special Permit under §174-45.4 of the Zoning By-laws to allow <br /> for construction of a 1,478 sq. ft. accessory apartment in the basement on property located <br /> in an R-3 Zoning District, (Map 93 Parcel 29), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 20, 2016 and May 27, 2016 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 8, 2016 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Ron Bonvie,Dom DeBarros,and Scott Goldstein,and Associate Members,Brad <br /> Pittsley and Norman J. Gould. Also present was Building Commissioner, Michael <br /> Mendoza. <br /> Mr. Bonvie recused himself from this hearing. Mr. Gould sat in on this hearing. <br /> Mr. Steve Cook, Cotuit Bay Design represented the homeowners who were also <br /> present at the meeting. Mr. Cook provided a floor plan of the proposed accessory <br /> apartment. He said a chair lift will be installed going up to the hallway adjacent to the <br /> garage on the first floor, and he will install a door where there is currently a window, as <br /> well as three egress window wells. The height in the basement is 8 feet, and will meet all <br /> the dimensions and requirements of the bylaws. The existing house area is 4,484 sq. ft.,the <br /> maximum size of the apartment will be 1,478 sq. ft.The house currently has four bedrooms, <br /> but will be removing a bedroom from the second floor to add the bedroom in the basement. <br /> This project cannot be seen from any public way or abutters, and the property is very <br /> private with an existing fence, pool, trees and shrubbery. There is plenty of parking but <br /> there will be no additional vehicles at this home. <br /> 1 <br />
