Dorado Bk#: 29001 <br /> 154 Wheeler Road Page#: 2 <br /> (Map 49 Parcel 7) <br /> Mashpee,MA 02649 <br /> A Petition was filed on April 25, 2016 by Denise A. Dorado requesting a Variance <br /> under §174-31 to vary the side yard setbacks and lot size requirements to allow for <br /> construction of a deck and stair addition on property located in an R-5 Zoning District, <br /> (Map 49 Parcel 7), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpce Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 3, 2016 and May 13, 2016 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpce Town Hall on <br /> Wednesday, May 25, 2016 at which time the following members of the Board of Appeals <br /> were present, Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, and Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Matt Costa with Cape & Islands Engineering represented the application. The <br /> property is located on 154 Wheeler Road and boarders Ashumet Pond. The deck structure <br /> will run the length on the back of the dwelling. The lot was created in 1947, and at that <br /> time was approximately 54,000 sq. ft. lot and was revised in 1957 down to a 26,000 sq. ft. <br /> lot. In 1988 a road taking was done,and reduced a portion of the property reducing it further <br /> by approximately 1,500 square feet. The total area now is about 26,387 sq. ft. in an R-5 <br /> zone. The dimension on the north side of the existing structure and garage is about 15.6 ft. <br /> at the closest point to the existing structures. The relief would be 16.5 ft. so the deck will <br /> not be any closer than what currently exists. The existing garage is about 12.2 ft. off the <br /> property line which is even closer. He said they received approval from Conservation, and <br /> are required to put a mitigation plan together along the property line. <br /> 1 <br />
