Kadis <br /> 706 Old Barnstable Road (Map 79 Parcel 66) <br /> Mashpee, MA 02649 <br /> AP-2016-16 <br /> Mr. Bonvie read the Conservation Comments into the record; "the property is not <br /> within wetlands jurisdiction." <br /> Mr. Goldstein read the Board of Health comments into the record; "This property <br /> may only have four bedrooms. The front main house was to have a wall between two <br /> bedrooms upstairs removed or a 6' opening made to make it into one large bedroom. That <br /> would reduce the bedrooms to three in the main house and one in the rear building for a <br /> total of four. The property is in Zone II and is restricted to four bedrooms." <br /> Mr. Furbush read the comments from the Inspection Department into the record; <br /> "The area is zoned R5 and is in the Pre-contact Archaeology Sensitivity area — listed as <br /> "High Sensitivity". The applicant is seeking an Administrative Appeal to the Building <br /> Commissioner's decision. (See attached documents)." The attached documents reference <br /> the letter sent to the homeowner and are on the record. <br /> Mr. Furbush and Mr. Blaisdell both pointed out that the application, which was <br /> advertised,was regarding both abandonment and an in-law suite,not the issue of Use. They <br /> have to vote on what was posted in the paper. <br /> Mr. Bonvie made the motion to approve the reversal of Building Commissioner's <br /> Decision under M.G.L. Chapter 40A §8 and §15, and §174-19 of the Zoning Bylaws to <br /> prohibit in-law suite with bedroom use in accessory structure on property located in an R- <br /> 5 Zoning District, (Map 79 Parcel 66), Mashpee, MA. Upon motion duly made and <br /> seconded by Mr. Blaisdell, the Board voted unanimously 5-0 to deny the application to <br /> appeal the Building Commissioner's decision at the Public Hearings on Wednesday,April <br /> 27, 2016. <br /> 3 <br />
