Poole requesting a <br /> 5 ft. Variance of the side yard setback under §174-31 of the Zoning Bylaws to allow for <br /> construction of an attached garage on property located in an R-5 Zoning District (Map 37 <br /> Parcel 160), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 4,2016 and March 11, 2016 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning Bylaws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,March 23,2016 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Scott Goldstein, Dom DeBanos, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Ms. Claire Poole represented herself requesting an attached garage. She said the <br /> original plans for the property had a garage design, but it was never built. The plan she <br /> submitted with the application depicted a 15' x 22' garage, and an addition in the rear of <br /> her property that has a building permit and is currently under construction. She said other <br /> properties in the neighborhood are similar in structure to hers and have garages. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> March 23,2016,the Zoning Board of Appeals voted unanimously to issue a Variance with <br /> the following conditions: A Plot Plan of Land-Prepared for #15 Scenic Drive, Mashpee, <br /> MA, Date: November 20, 2015, Scale: 1" = 20', by Stephen Doyle and. Associates, 42 <br /> Canterbury Lane, East Falmouth, MA.
