Appleman Bk#: 27283 <br /> 91 Edgewater Road Pagc#: 127 <br /> (Map 23 Parcel 119) <br /> Mashpee, MA 02649 <br /> A Petition was filed February 26, 2016 by Joseph H. Appleman requesting a <br /> Variance to extend an existing deck 8 ft. under §174-33 of the Zoning Bylaws to vary the <br /> setback at least fifty (50') feet from any water or wetlands on property located in an R-5 <br /> Zoning District, (Map 23 Parcel 119), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 4, 2016 and March 11, 2016 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,March 23,2016 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Scott Goldstein, Dom DeBarros, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Joseph Appleman represented himself for the dock expansion project. He <br /> provided the Board with a plan and a hand-drawn picture of the dock he wants to expand <br /> 8 ft. located 22 feet uphill from Santuit Pond. <br /> The Conservation Commission held hearings on April 28, 2016 and unanimously <br /> voted to revoke the permit that they issued due to a pattern of wetland violations that have <br /> occurred at the property over the last two years. As a result the Zoning Board of Appeals <br /> decided to re-open the case and notified Mr. Appleman via certified letter dated May 2, <br /> 2016 to attend the hearings on Wednesday, May 11, 2016. <br /> At the hearings dated Wednesday, May 11, 2016, Mr. Appleman represented <br /> himself and said he didn't understand why he was asked to attend this meeting and <br /> wanted an explanation. <br /> 1 <br />
