Tomm of Maslipee <br /> 16 (,'real Ac � o a <br /> .� acl Af ar•th <br /> ="�`"" f$litslt�x�e,r�'1crs,sct.cJ�r�setts O;u(i�9 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> WITHDRAWAL OF A WRITTEN FINDING <br /> FINDING-2016-02 <br /> Kevin Cayer Bk#: 12042 <br /> 190 Monomoscoy Road Page#: 338 <br /> (Map 114 Parcel 41 A) <br /> Mashpee, MA 02649 <br /> A Petition was filed by Kevin Cayer requesting a Written Finding under §174-17 <br /> of the Zoning Bylaws to allow for construction of a 4 ft. wide walkway, wooden stairs, and <br /> a 4 ft. by 4 ft, wooden platform, on property located in an R-3 Zoning District, (Map 114, <br /> Parcel 41A), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpce Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on December 18, 2015 and December 25, <br /> 2015. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 13, 2016 at which time the following members of the Zoning Board <br /> of Appeals were present; Chairman, Jonathan Furbush,Vice Chairman, William Blaisdell, <br /> Board Member, Dom DeBarros, and Associate Members Brad Pittsley and Norman J. <br /> Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Kevin Cayer represented himself for the application to construct a wooden <br /> walkway and platform on his vacant lot next to Great River. He stated he currently has a <br /> mooring and would like to access his boat without having to row out to it. The plot plan he <br /> provided shows the vacant lot and the proposed 4' pathway and wooden platform on the <br /> edge of the marsh. He also provided an assessor reap showing his vacant lot and the <br /> causeway showing the distance from his current residence at 98 Bayshore Drive. <br /> Mr. Furbush read comments from the Conservation Department into the record <br /> which requires onsite pre-work on the pathway with placement of hay bales. The comment <br /> from the Inspection Department does not support such situations within the Town of <br /> Mashpee. Mr. Furbush said a dock is considered an accessory structure and is not allowed <br /> under the Bylaws. <br /> 1 <br />
