SP-92-7 <br /> A Petition was filed by J . Tarabelli & Sons Inc . for a <br /> Special Permit under Section 174- 17 of the Zoning By- laws for <br /> permission to expand a non-conforming structure with a <br /> second-floor addition in an R-3 zoning district on property <br /> located at 9 Beach Road ( Map 123, Block 156 ) Mashpee, MA . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 24 and January <br /> 31 , 1992, a copy of. which is attached hereto and made a part <br /> hereof . <br /> A public hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, February 12, 1992 at 7 : 30 P. M . at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout : Michael A. Makunas, Cheryl A . <br /> Hawver and John J . 'Friel . <br /> J . Tarabelli represented the Petition and informed the <br /> Board that the owners of the property were replacing a <br /> foundation and adding a second floor to an existing <br /> structure . The project had received an Order of Conditions <br /> from the Conservation Commission . Attorney Andrew Daniels, <br /> representing direct abutters, objected to the Petition and <br /> stated that damage had been done to his clients ' property <br /> during the installation of a new septic system and that a <br /> deck had been added to the property by a previous owners and <br /> had not been permitted .
