MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Edwin M. and Virginia D. Thomas for a Special Permit SP-92-8 <br /> A Petition was filed by Edwin M. and Virginia D. Thomas of <br /> N. Quincy, MA for a Special Permit under Section 174-25.1.9 of the <br /> Zoning By-laws for permission to construct a pier on Popponesset <br /> Creek in an R-3 zoning district on property located at 46 Spoondrift <br /> Way (Map 111, Block 128) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 21 and February 28, 1992, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 11, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel. <br /> Engineer Christopher Costa represented the applicant and presented <br /> plans for a dock. He explained that he had revised plans to reduce <br /> any impact on the shellfish beds at the suggestion of the Shellfish <br /> Warden. Comments were received from the Waterways Commission questioning <br /> water depths in the area. Mr. Costa explained that revised plans <br /> had been submitted to the Waterways Commission with the soundings. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the zoning bylaws and complies with the provisions <br /> therein. The Board determined that the structure would not interfere <br /> with the free passage of travel by water or cause disruption to <br /> the marine environment. <br />
