Box 1108 <br /> �eLe MASHPEE, MA 02649 <br /> Board of Appeals <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> Re : Linda Raub Zammer for a Special Permit SP-92-10 <br /> A Petition was filed by Linda Raub Zammer for a Special <br /> Permit under Sections 174-17, 174-22 through 174-25 of the <br /> Zoning By-laws for permission to expand a non-conforming <br /> structure and operate a full service restaurant in a C-1 <br /> zoning district at 620 Falmouth Road (Map 74, Block 6 ) <br /> Mashpee, MA. (Owner of record : Jorlen Corp. ) <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication. in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on February 7 and 14, <br /> 1992, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, February 26, 1992 at 7 : 30 P.M. and <br /> continued on March 11 , 1992 at which times the following <br /> members of the Board of Appeals were present and acting <br /> throughout : Michael A. Makunas, Cheryl A. Hawver and John J. <br /> Friel . <br /> Douglas Storrs of Cornish Nominee Trust, new owners of <br /> the property, informed the Board that Mrs . Zammer plans to <br /> renovate and expand the former Pickwick ' s Restaurant and <br /> presented plans which had been approved by the Design Review <br /> Committee . Board members expressed concerns with the traffic <br /> conditions and new plans were presented on March 11 , 1992 <br /> with one curb cut on Route 28 and one curb cut on Donna ' s <br /> Lane . Mr. Storrs stated that negotiations were in progress <br /> with the Selectmen on the improvement of Donna ' s Lane . <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the Zoning By-laws and complies <br /> with the provisions set forth therein. The Board determined i <br /> that the extension, alteration and change shall not -be <br /> more detrimental to the neighborhood than the existing non <br /> conforming use. <br /> i <br /> i <br /> •s <br />
