Board of Appeals Minutes - December 9 , 1992 3 . <br /> George E . Mandalos - Requests a Special Permit under Section <br /> 174-25 . 1 . 9 of the Zoning By-laws for permission to extend an <br /> existing pier and add another float in an R-3 zoning district <br /> on property located at 22 Cross Tree Way (Map 112 , Block 23 ) <br /> Mashpee, MA. <br /> Members sitting : J . Friel, M. Makunas, C. Hawver <br /> Mr . Mandalos explained that there is a license on the existing <br /> dock and he proposed to add 2 8 ' x 16 , timber floats and <br /> extend the existing pier by 101 . No comments were received <br /> from Conservation but Mr . Mandalos said Conservation had <br /> suggested reduction in size of floats to 214 sf . The <br /> Shellfish Constable recommended the float area be revised to <br /> 200 sf or less . Mr . Friel explained that the plans would have <br /> to be modified to reflect the reduced float area and signed by <br /> an engineer. <br /> Mr . Makunas moved to grant the request pending receipt of <br /> signed plans . Ms . Hawver seconded. All agreed. <br /> Joseph and Betsy L Chiasson - Request a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the <br /> setback requirements in an R-3 zoning district on property <br /> located at 89 Shore Drive (Map 117 , Block 341 ) Mashpee, MA. <br /> Members sitting : J . Friel, M. Makunas, C. Hawver <br /> Mr . Chiasson explained that a deck had been built on his <br /> property without a building permit. The deck is 9 . 23' from <br /> the side line . He said a tenant had built the deck in lieu of <br /> rent . The Board discussed height of the deck and determined <br /> it was appoximately 24 , off of the ground. Mr. Chaisson said <br /> that the deck provided access to a side door. Virginia Landry, <br /> a resident of Popponesset, reviewed the plans . <br /> Mr . Makunas informed the applicant that he would have to prove <br /> a hardship which could not be self-imposed. He said that the <br /> fact that it ws built without a permit too close to the lot <br /> line did not constitute hardship. Mr . Hauck said he is <br /> allowed a four to five toot square landing and asked if the <br /> Board would approve a four foot walkway to the rear deck. Mr. <br /> Makunas said it would still be non-conforming and would <br /> require a Variance . It was suggested the applicant supply <br /> information on hardship. <br />
