Board of Appeals Minutes - October 14, 1992 <br /> 3 . <br /> Mr. Govoni asked for measurement from lot line and Mr. Edward <br /> Pesce, the engineer, said it was 21 . <br /> James Candido, 70 Nick Trail, objected and said the owner never <br /> applied for a building permit or a Variance. He said he <br /> complained to the Building Inspector in May that the shed was <br /> blocking his water view. He said he should have been contacted <br /> as an abutter. He said there are 10 sheds in the neighborhood. <br /> He requested that the shed be moved 15' to 20 ' to the right . He <br /> reported his calls to the Building Inspector notifying him of <br /> the violations . He presented photos of his property showing the <br /> impact of the shed. <br /> Ms . Jalkut said she had contacted abutters and Mr. Friel <br /> explained that she should have had a building permit and a <br /> Variance . <br /> Mr. Friel suggested shed be 10 ' from sideline and 2' from rear <br /> lot line. Mr . Pesci said he would revise and sign plans with <br /> exact measurements. Mr. Govoni moved to grant the Variance <br /> allowing 2 ' from the rear lot line and 10 ' from the sideline <br /> pending receipt of documentation. Mr . Makunas seconded. All <br /> agreed. <br /> Fields Point Ltd. Fartnershi - Requests a Special Permit under <br /> Section 174-25 of the Zoning By-laws and the conditions of <br /> Sp-86-04-024 for permission to construct Building 24 for a <br /> hardware store in a C-1 zoning district on property located at <br /> 38 Nathan Ellis Highway (Map 74, Block 20 ) Mashpee, MA. <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Douglas Storrs of Fields Point represented the applicant. He <br /> reviewed the conditions of the original permit whereby they <br /> return to the Board to review site plans and apply for Design <br /> Review approval . He said he did not have Design Review <br /> approval . He reviewed plans and explained that there may be <br /> changes in order to screen the building from the rotary. The <br /> building will be 12, 000 sf and 14 ' high at corners and be one <br /> story with a 30 ' garden center area attached. <br /> Mr . Friel asked why this lot was chosen and Mr. Storrs replied <br /> it was the only lot left to accomodate this size building. He <br /> said landscaping on slope would be unchanged. There was <br /> discussion of trucking access and Mr. Storrs explained that the <br /> owner has a warehouse on Cape and that deliveries to this store <br /> would be by smaller trucks. <br />
