Friel said he had no problem with this and he <br /> thought that legally the Board could add a modification to the <br /> permit for clarification. Mr . Dunning explained that Mr. <br /> Marsters had contractual obligations to customers and would like <br /> a clarification tonight. <br /> Mr . Friel said he did not think the permit was in default and <br /> that the ten year limit was not mandatory but any further <br /> changes would require a modification at a public hearing. He <br /> said the Board of Appeals could inform the Building inspector <br /> that permits could be issued. <br /> Mr.Makunas interpreted that the restrictions applied to the <br /> condos . He moved that the "Board interprets #3. as meaning that <br /> the 10-year restriction applies to the condominiums and not to <br /> the single family lots and that #10 , it is this Board' s opinion <br /> that the permit is not in default by the terms of the decision <br /> and because records were not kept by the Building Inspector and <br /> cannot be verified. " Mr . Makunas said no limit had been put on <br /> the single family homes . Mr . Govoni seconded. All agreed. <br /> Subdivision Appeals Board - Mr . Govoni moved to appoint Mr. <br /> Friel to the Subdivision Appeals Board.
