Board of Appeals Minutes - September 9, 1992 6. <br /> Mr. Friel asked if he wanted continuing use and he said he would . <br /> Mr. Gildea said they would be happy to comply. Mr. Makunas asked <br /> for a review of the conditions in violation and read the <br /> conditions --- none of which had been complied with. Mr. Zammer <br /> said he had phoned the Board of Appeals in August saying he was <br /> Mr. Makunas moved to vote that the petitioner has not complied <br /> with the Special Permit. Mr. Govoni seconded . All agreed . <br /> There was discussion of the August 12 meeting of the Design Review <br /> which Mr. Zammer could have attended. Mr. Gildea said Mr. Zammer <br /> was working to comply with conditions . He also questioned the <br /> ability of the Board to rescind the Special Permit . He thought it <br /> was an enforcement issue from the Building Inspector. <br /> Mr. Gildea said Mr. Zammer was going to meet with the State on <br /> September 10 and would appear at Design Review on September 16 . <br /> Mr. Makunas moved to rescind the Special Permit and Mr. Govoni <br /> suggested they try to resolve the issues . Mr. Friel said issues <br /> should be resolved by the next meeting on September 23, 1992 and <br /> plans should reflect everything on the lot . <br /> Mr. Makunas moved to take under advisement until September 23, <br /> 1992 . Mr. Govoni seconded . All agreed. <br /> Karen Jalkut -- Mr. Friel moved to grant a 30-day extension in the <br /> hearing calendar. Mr. Makunas seconded . All agreed . <br /> Minutes - Mr. Friel moved to accept the minutes of July 29 and <br /> August 12 . Mr. Govoni seconded . All agreed . <br /> Mr. Hauck discussed non-conforming lots with Board members . Mr. <br /> Friel said notices should be sent to .lot owners . Mr. Hauck said <br /> that he wanted to prepare a report on all of the lots and review <br /> it with Town Counsel . There was discussion that the Town had <br /> rescinded the protection of the contiguous non-conforming lots at <br /> the 1990 Town Meeting . <br /> Mr. Regan suggested a review of the Jones and Benway applications <br /> heard earlier in the evening. <br /> Mr. Makunas moved to grant the Special Permits for Edward E. Jones <br /> and Patricia M. and Mary Alice Benway TRS. Mr. Friel seconded . <br /> All agreed . <br /> Mr. Makunas moved to adjourn at 9: 45 P.M. Mr. Friel seconded . <br /> All agreed . <br /> Elinor Walsh <br />
