All agreed. <br /> Mr. Friel noted that under Section 174-105 there was a fine of $300 per <br /> day for violations. <br /> Cheapo Depot - Mr. Friel read Mr. Taylor's memo that Tilcon was filing <br /> for a curb cut permit to widen the entrance to Cheapo Depot. Mr. Taylor <br /> informed the Board that the State would be working on the drainage of <br /> Route 28 this fall and repaving would be done in the Spring. <br /> Mr. Friel moved to recess at 8:45. Mr. Govoni seconded. All agreed. <br /> Mr. Friel reopened the meeting at 9:05. <br /> Mr. Friel informed the Board that he had received a request from the <br /> Board of Health to allow sales of fruits and vegetables at the Flea <br /> Market. The Board of Health wanted Louis Minerella to relocate his <br /> truck from Orchard St. to the Flea Market for the sale of corn. <br /> Mr. Hauck said that the Town has no enforcement rights on the flea <br /> market until the current litigation is resolved. <br /> Koulouri.s cont. - Mr. Dunning said that the two parties were not able <br /> to agree on a compromise. He said the Koulouris' had agreed that the <br /> deck would be back 2' from the property line and that plantings would <br /> be installed and they would pay $245 of the engineering fees but did <br /> not agree to the condition to be placed on the deed that the deck be <br /> removed if the property was sold. <br /> Mr. Makunas discussed the option of withdrawing and determining that the <br /> structure was an illegal, non-conforming pre-existing structure. <br /> Mr. Friel moved to deny the application with prejudice. Mr. Govoni <br /> seconded. All agreed. <br /> Mr. Friel moved to go into Executive Session and announced that the <br /> Board would not reconvene after the meeting.
