i <br /> TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, July 29, 1992 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, July 29, 1992 at <br /> 7:30 P.M. at the Mashpee Town Hall. Board members present and acting <br /> throughout were John J. Friel, Michael A. Makunas, Edward M. Govoni and Jamie <br /> Regan. Acting Building Inspector William Hauck was present. Mr. Friel called <br /> the meeting to order at 7:35 P.M. <br /> Richard M. and Estelle G. Cushner - Request a Special Permit under Section <br /> 174-25.1.9 of the Zoning By-laws for permission to construct a permanent <br /> timber pier in the waters of Great River to replace an existing seasonal <br /> pier in an R-3 zoning district on property located at 22 Samoset Road (Map <br /> 125, Block 65) Mashpee, MA. <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Attorney Kevin Kirrane represented the applicant and explained that there <br /> was a temporary dock at the location and the applicant now wishes to make <br /> it a permanent structure. He said the length is being reduced and no ramp <br /> or float would be used in conjunction with the pier. <br /> Mr. Friel asked how many boats would be used and Dr. Cushner said only two <br /> boats would be used. There was discussion of shellfish in the area and Michael <br /> McGrath, Engineer of the project, said clam digging had disrupted much of <br /> the area. He explained that the seasonal removal of the temporary dock caused <br /> more environmental damage than the new one would and boats would only be <br /> tied on one side. <br /> Mr. Makunas moved to grant the Special Permit. Mr. Govoni seconded. All <br /> agreed. <br /> Bayport Homes Inc. - Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the setback requirements on corner lots in <br /> an R-5 zoning district on property located at 95 Shields Road (Map 38, Block <br /> 18) Mashpee, MA. (owner of record: Peco Inc.) <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Craig Weedon of Bayport Homes reviewed plans for a proposed home on a lot <br /> which appeared to be a corner lot but the adjoining road is not going to <br /> be built and will be a cul-de-sac. <br /> Mr. Govoni moved to grant the Variance allowing for a 14.3' and 9' <br /> setback. Mr. Makunas seconded. All agreed. <br />
