Board of Appeals Minutes - July 29, 1992 6. <br /> Mr. Makunas withdrew his motion. He suggested itemizing the conditions and <br /> understand the issues. <br /> There was discussion that the expiration date of August 3, 1992 could be <br /> resolved. <br /> Mr. Makunas moved to accept the request to withdraw the current application <br /> for the Modification of Special Permit 92--9. Mr. Govoni seconded. Mr. Friel <br /> explained that the application for the transfer was still valid. Mr. Kirrane <br /> confirmed that he was withdrawing the part of the application relating to <br /> modification since he slid not believe that the issue of the transfer could <br /> be addressed in litigation. <br /> Ms. Morse said the issue of the transfer could not be settled with the <br /> litigation. <br /> Mr. Makunas moved to withdraw his motion to accept the request to withdraw. <br /> Mr. Govoni seconded. All agreed. <br /> Mr. Makunas moved to deny. No member moved to second the motion. Ms. Morse <br /> said the motion failed since there was no second. <br /> Mr. Govoni moved to take the application under advisement. Mr. Friel <br /> seconded. Mr. Makunas made the motion unanimous. <br /> Mr. Siegel, attorney for Mr. Talanian, explained that they would like to <br /> have a permanent permit. Ms. Morse said she would meet with the Board in <br /> Executive Session and she would then meet with Mr. Kirrane. <br /> Mr. Siegel said there have been many meetings with various agencies of the <br /> Town in settling the issues of Donna's Lane and that there is now a time <br /> deadline because of the planned improvements on Route 28. Mr. Makunas agreed <br /> and Mr. Friel stated that discussion was closed following the motion to take <br /> the application under advisement. <br /> Mr. Friel moved to adjourn at 9:15 P.M.
