Board of Appeals Minutes - July 15, 1992 3 . the by-laws and said he did not understand why he could sell one type of food and not another. Mr. Friel explained that the Board must act under the current by-laws . Lynn Lerman, a member of the audience, spoke in favor of the stand and said it was a great convenience. William Hauck explained that Mr. Zammer did not properly apply for the Permit and he had no plan on file and should have applied for the modification three months ago. Mr . Zammer said he had a septic plan and Mr. Hauck said he required a plan with the stands included. Mr. Friel explained that this was an expansion of the use and Mr. Makunas asked if the Design Review Committee had approved the plan . Mr . Govoni and Mr. Friel expressed concern on traffic conditions at the site and both agreed that the DPW Director and Field' s Point should review the problems and report back to the Board. Mr . Makunas moved to grant the request for the outdoor sale of produce and flowers under Section 174-25 .F. 5 of the Zoning By-laws with the following conditions : 1 . applicant to submit an engineer' s pian which shows structures, parking, curb cuts, and any improvements in the appearance or landscaping 2 . applicant to appear before the Design Review Committee for approval of plans 3 . applicant to review curb cuts with the State DPW and Gregory Taylor, Director of Mashpee Public Works . 4 . applicant to report back to the Board within 30 days but stand may operate during this period. Mr. Friel called a recess at 8: 10 P.M. Board reconvened at 8 : 20 P .M. W. R. Harvey d/b/a Mashpee Storage - Requests a Special Permit under Section 174-25 .G. 7 of the Zoning By-laws for permission to operate a U-Haul Truck Rental Outlet in an 1-1 zoning district on property located at 848 Falmouth Road (Map 88, Block 2A) Mashpee, MA.
