Board of Appeals Minutes - July 15, 1992 8 . <br /> KEVIN KIRRANE - Discussion <br /> Mr. Friel announced that there was pending litigation on the <br /> Flea Market and Mr . Kirrane had requested discussion. Mr. <br /> Kirrane discussed the earlier hearings on the Flea Market <br /> Special Permit and said, the Board had concerns at that time <br /> on the issue of Donna' s Lane and the traffic problems . He <br /> interpreted the Board' s intent to be an application for a <br /> modification of the Special Permit but he filed an appeal <br /> only to preserve his client' s rights . <br /> He said it was his intent to transfer the permit, to improve <br /> 128 and Donna' s Lane and that the Donna' s Lane issue would <br /> have been resolved if it had not been for the Pickwick' s <br /> fire . Mr. Talanian has agreed to 50% payment for Donna' s <br /> Lane . Mr . Kirrane said a new application has been filed for <br /> a modification but he did not know if this could be <br /> considered without the remand. <br /> Mr . Kirrane said the state will be improving Route 28 and Mr. <br /> Talanian has been working with Gregory Taylor on plans for <br /> the land. He presented plans for changes in the curb cuts on <br /> 28 and on Donna' s Lane . <br /> Mr. Friel questioned the use of the loudspeakers and the <br /> overflow parking on Great Neck Road South and Route 28 . <br /> Louis Marandola, operator of the Flea Market, said the system <br /> does not go on until 11 A.M. and that the speakers might be <br /> redesigned to contain sound. He also said they have having a <br /> police detail every weeked. Mr. Friel said that parking could <br /> be organized on such a large site. <br /> Charles Talanian said he would be coming with the plan they <br /> now have for the curb cuts and relocation of the mini-golf <br /> and they will work to handle what they have . There is an <br /> additional 11 acres that could be cleared. Mr. Kirrane said <br /> that in conjunction with the transfer they could include , <br /> parking attendants . <br /> Board Members discussed fact that they were negiotiating <br /> without counsel. Mr. Kirrane said he was told that Town <br /> Counsel had made a recommendation to remand the case. Mr. <br /> Friel said it was his intention to bring up some of the <br /> issues which had come from Mr. Reardon. Mr . Makunas said he <br /> believed the Board should agree to the remand. Mr. Govoni <br /> moved to remand. Mr. Makunas seconded. All agreed. <br /> MINUTES - Mr. Govoni moved to accept the Minutes of June 24, <br /> 1992 . Mr . Makunas seconded. All agreed. <br /> Mr. Govoni moved to adjourn at 10 : 15 A .M. Mr. Makunas <br /> seconded. All agreed. <br /> Elinor Walsh <br />
