Board of Appeals Minutes - March 25, 1992 4. <br /> He also conducted shellfish studies and stated that the area is a marginal <br /> shellfish habitat. He said that this configuration conforms to the current <br /> performance standards for a pier and the impact is not significant. Mr. <br /> Govoni asked if a variance would be needed since the structure was not 25' <br /> from the lot line and Mr. Forns said the Army Corps of Engineers would accept <br /> lesser distances if abutters wrote a consent. Mr. Makunas asked for a copy <br /> of the study and said it would be helpful to have a similar study done in <br /> five years to determine the impact of boating on the area. Mr. Forns said <br /> he had aerial photographs of Jehu Pond showing all of the piers in the area. <br /> Mr. Govoni questioned if a Variance for a side line setback was required <br /> and the Board agreed that this would be necessary before a Special Permit <br /> could be issued. <br /> Mr. Friel moved to take the application under advisement. ..Mr. Govoni <br /> seconded. All agreed. <br /> Minutes - Mr. Friel moved to accept the minutes of March 11 , 1992. Mr. Govoni <br /> seconded. All agreed. <br /> Mr. Govoni moved to adjourn at 9.35 P.M. Mr. Friel seconded.
