Boyd : What they had planned to do originally was to <br /> enclose the two ends, the roof . . . . <br /> V . Driscoll : That is not considered a side . <br /> D . Boyd : . . . and shrink wrap the other two sides . <br /> M . Makunas : If you ' ve got boats going in and out of two <br /> sides -- you ' ve only got two sides . <br /> D. Boyd : I ' m not legally astute enough to comment . <br /> M . Makunas : Let ' s be practical about it . The building can <br /> have two sides on it but it can ' t have the <br /> other two sides . . . . <br /> ? So it ' s a violation of the zoning by- law. <br /> M. Makunas : The zoning by- law obviously didn ' t have this <br /> problem in mind . <br /> D . Boyd : When the by- law was created we didn ' t have <br /> rack storage . <br /> M . Makunas : That ' s what I mean . In other words, we didn ' t <br /> have this particular situation . <br /> W. Hanrahan : There has to be a determination whether it is <br /> a violation if we can ' t get an answer from the <br /> Building Department . <br /> M . Makunas : We can make that decision . <br /> W . Hanrahan : I can ' t make it without looking at it . <br /> S . ferry : Hasn ' t that already been determined with the <br /> denial of the change in the By- law? That <br /> change in the By-law was brought before the <br /> October Town Meeting -- the Spring Town <br /> Meeting -- and it was defeated . So the By- law <br /> still stands, it hasn ' t been changed . <br /> W. Burtis : The Fire Department does not allow to enclose <br /> that building on three sides . <br /> W . Hanrahan : Obviously, it is going to take more <br /> investigation than we can do tonight -- I ' d <br /> like to read the By-law, look at the site . <br /> I 'm not prepared to make a decision on it . <br /> K . Perry : You ' re not prepared to make a decision <br /> tonight . However, when this boat rack storage <br /> went up without a permit all of this stuff <br /> should have been investigated up front . If he <br /> knew that there was a Town By- law that was <br /> supposed to have that enclosed on three sides, <br /> then they should have made their plans <br /> accordingly . No regard to any rules, laws, <br /> regulations or anything else. <br /> M . Makunas : I want to know what is the schedule on Design <br /> Review and on the bond . What is the time <br /> frame? When can Design Review expect to be <br /> advised on the schedule and when can . . . . <br /> W . Burtis : When you have your meeting . <br /> q M. Makunas : Will you have your plans? <br /> W. Burtis : I ' ll have the old plan and try to revise it . <br /> M. Makunas : So you ' ll have a new plan . What ' s a good <br /> time? You pretty much schedule . . . . <br />
