Board of Appeals Minutes - October 23, 1991 8 .
} W . Burtis ; Right there at the Boatyard where it has
been . . . near the shed .
K . Perry : I know where it is -- 10 or 12 feet from the
river.
E. Thibeaut : There ' s another condition . #7 -- the facade .
That was an issue too .
W. Hanrahan : We ' re not done yet -- we ' ll get to it . Mrs .
Driscoll ?
V . Driscoll : The fuel tanks are a condition -- #13 . I
called the EPA and Public Safety . They have
no record of any plan being filed for fuel
tanks .
D. Boyd ; As I understand, the State Fire Marshall who
was in charge of this has since retired so God
knows where it is in the process . I did ask
George Baker about it .
V. Driscoll : I can also make another comment on it . He
refused to render a decision because of the
dirty politics in Mashpee . That was his
comment to me .
W. Hanrahan : That ' s out of order . I ' m sorry, M ' am, that ' s
out of order.
V. Driscoll : I think this whole hearing is out of order.
W. Hanrahan : That ' s out of order. On the matter of the
landscaping it says that before the outer
facade and landscaping on the Riverside Avenue
property line is constructed, the Applicant
shall present plans prepared by a registered
landscape architect to the Design Review
Committee for their approval . Has that been
done Mike? You ' re a member of that Committee .
M . Makunas : The original plan -- Design Review has not
looked at anything since the original plan .
W. Hanrahan : Did the Design Review Committee and the
Applicant finally agree on a design for the
facade?
M . Makunas : The original plan .
W. Hanrahan : What I ' m getting at is the status of the
$ 10, 000 bond .
D. Boyd : There is no bond .
W . Hanrahan : Should there be one?
D. Boyd : Yes, there should be .
W. Burtis : Could I express my feelings on that?
W. Hanrahan : Yes, go ahead .
W. Burtis : The landscape architect ' s drafting when we
went before their Board was when the building
was within so many feet of Riverside Road .
Then we got into all this litigation . I
didn ' t do it because I couldn ' t move . I had a
stop work order put on the building and why I
say now, why I didn ' t have a bond, is because
I think I have to go before the Design Review
again because I am 50 some feet from Riverside
Road and if I took that plan that you have on
