1 <br /> TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, July 24, 1991 <br /> The Mashpee Board of Appeals held a meeting at 7:30 P.M. on <br /> Wednesday, July 24, 1991 at the Mashpee Town Hall. Board Members <br /> present and acting throughout were: William J. Hanrahan, Michael A. <br /> Makunas, Edward M. Govoni, John J. Friel and B. Thomas Christian. <br /> Shellfish Warden Paul Somerville was in attendance. <br /> Mr. Hanrahan, Acting Chairman, called the meeting to order at <br /> 7:35 P.M. <br /> David Wolfe TR - Requests a Special Permit under Section 174-25.1.9 <br /> of the Zoning By-laws for permission to reconstruct an existing pier, <br /> ramp and float in an R--3 zoning distract on property located at <br /> 12 Cross Tree Way (Map 112, Block 21) Mashpee, MA. <br /> Members sitting: W. Hanrahan, M. Makunas, E. Govoni <br /> Attorney Albert Schultz represented the applicant. He reviewed <br /> plans of the existing dock and informed the Board that the float <br /> section had been redesigned at the request of the Conservation <br /> Commission. The area of the dock has been reduced by 41sf and <br /> the dock extended so that floats would not be sitting on the <br /> bottom at low tide. Mr. Friel questioned if boats would be docked <br /> on the outside of the dock and Mr. Schultz said he expected this <br /> to be one of the Orders of Conditions from Conservation. <br /> Mr. Hanrahan moved to grant the Special Permit. Mr. Govoni <br /> seconded. All agreed. <br /> Robert K. and Myra H. Kraft - Request a Special Permit under <br /> Section 174-17 and 174-25.1.9 of the Zoning By-laws for an existing <br /> pier, ramp and float in an R-3 zoning district on property located <br /> at 24 Popponesset Island Road (Map 105, Block 254) Mashpee, MA. <br /> Members sitting: W. Hanrahan, M. Makunas, J. Friel <br /> Engineer Stephen A. Wilson represented the applicant. He <br /> explained that the pier had been licensed in 1956 and modified in <br /> 1966 and 1981 and the applicant is now seeking a Chapter 91 <br /> Waterways license under the amnesty program. Mr. Somerville <br /> noted that there were some pilings on the structure which .did <br /> not appear on the plans. Mr. Somerville also stated that the <br /> area contained shellfish and suggested that boats be confined <br /> to the float area. He said a 25' whaler is now used and stated <br /> that power boats with a 2 1/2' draft would not cause problems. <br /> Mr. Makunas stated that he, Mr. Hanrahan and Mr. Friel had <br /> visited the site. <br /> Mr. Hanrahan moved to grant the Special Permit with the stipulation <br /> that boat usage and anchorage be restricted to the immediate float area. <br />
