1 TOWN OF MASHPEE Board of Appeals Minutes Wednesday, July 24, 1991 The Mashpee Board of Appeals held a meeting at 7:30 P.M. on Wednesday, July 24, 1991 at the Mashpee Town Hall. Board Members present and acting throughout were: William J. Hanrahan, Michael A. Makunas, Edward M. Govoni, John J. Friel and B. Thomas Christian. Shellfish Warden Paul Somerville was in attendance. Mr. Hanrahan, Acting Chairman, called the meeting to order at 7:35 P.M. David Wolfe TR - Requests a Special Permit under Section 174-25.1.9 of the Zoning By-laws for permission to reconstruct an existing pier, ramp and float in an R--3 zoning distract on property located at 12 Cross Tree Way (Map 112, Block 21) Mashpee, MA. Members sitting: W. Hanrahan, M. Makunas, E. Govoni Attorney Albert Schultz represented the applicant. He reviewed plans of the existing dock and informed the Board that the float section had been redesigned at the request of the Conservation Commission. The area of the dock has been reduced by 41sf and the dock extended so that floats would not be sitting on the bottom at low tide. Mr. Friel questioned if boats would be docked on the outside of the dock and Mr. Schultz said he expected this to be one of the Orders of Conditions from Conservation. Mr. Hanrahan moved to grant the Special Permit. Mr. Govoni seconded. All agreed. Robert K. and Myra H. Kraft - Request a Special Permit under Section 174-17 and 174-25.1.9 of the Zoning By-laws for an existing pier, ramp and float in an R-3 zoning district on property located at 24 Popponesset Island Road (Map 105, Block 254) Mashpee, MA. Members sitting: W. Hanrahan, M. Makunas, J. Friel Engineer Stephen A. Wilson represented the applicant. He explained that the pier had been licensed in 1956 and modified in 1966 and 1981 and the applicant is now seeking a Chapter 91 Waterways license under the amnesty program. Mr. Somerville noted that there were some pilings on the structure which .did not appear on the plans. Mr. Somerville also stated that the area contained shellfish and suggested that boats be confined to the float area. He said a 25' whaler is now used and stated that power boats with a 2 1/2' draft would not cause problems. Mr. Makunas stated that he, Mr. Hanrahan and Mr. Friel had visited the site. Mr. Hanrahan moved to grant the Special Permit with the stipulation that boat usage and anchorage be restricted to the immediate float area.
