TOWN OF MASHPEE <br /> Board of Appeals <br /> Wednesday, May 22, 1991 <br /> The Mashpee Board of Appeals held a meeting at 7:30 P.m. on <br /> Wednesday, May 22, 1991 at the Mashpee Town Hall. Board Members <br /> present and acting throughout were Michael A. Makunas, Acting Chairman; <br /> William J. Hanrahan, Clerk and Associate Members Edward M. Govoni, <br /> John J. Friel and B. Thomas Christian. Building Inspector Douglas <br /> Boyd was in attendance. <br /> Robert P. Carvalho - Requests a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the front setback requirement <br /> in an R-3 zoning district on property located at 38 Driftwood Circle <br /> (Map 125, Block 194) Mashpee, MA. <br /> Members sitting: M. Makunas, W. Hanrahan, E. Govoni <br /> Architect Elizabeth Chapman represented the applicant. She explained <br /> that the shape of the lot required the owner to build an undersized <br /> garage and was requesting that 4' wing walls and overhang be added <br /> resulting in a front setback of 36'4". There were no abutters <br /> present. Mr. Makunas noted that the plans did not have an original <br /> signature and requested that a signed plan be received before the <br /> Decision was filed. Mr. Hanrahan moved to grant the Variance based <br /> on the hardship of the shape of thst lot. Mr. :'ovoni seconded. <br /> All agreed. <br /> Richard M. Cushner - Requests a Special Permit under Section 174-17 <br /> of the Zoning By-laws for permission to replace an existing non-conforming <br /> seasonal dock with a permanent dock in an R-3 zoning district on <br /> property located at 22 Samoset Road (Map 125, Block 65) Mashpee, <br /> Ma. (Owner of record: Richard M. and Estelle G. Cushner) . <br /> Members sitting: M. Makunas, j Hanrahan, J. Friel <br /> Attorney Gary Nichols represented the applicant. He presented <br /> plans for the replacement of a seasonal dock with a permanent structure. <br /> Mr. Hanrahan read a memo from Conservation stating their concerns <br /> with damage to shellfish beds and stating that Conservation had <br /> not requested the change from a seasonal dock. <br /> Paul Somerville, Shellfish Constable, stated that the present pier <br /> has not bben removed for the past three years and said that the <br /> use of this pier had caused substantial damage to the shellfish. <br /> Mr. Govoni questioned if the use of a ramp and float would improve <br /> the situation and Mr. Somerville replied that less damage would <br /> be done with the dock further out in the water. Dr. Kushner said <br /> the original pier was to be 125' long but it was shortened due <br /> to complaints from neighbors. Mr. Makunas stated that the plans <br /> were incorrect and did not show accurate documentation. Dr. Kushner <br /> said he would have the drawings corrected. <br />
