Board of Appeals Minutes - May 22, 1991 3. Donna J, Austin (cont.) 1 There was discussion that a Special Permit had been issued in 1990 for the use of the property as a non-alcoholic social club but that no action had been taken on the Permit. Elias McQuaid, Health Agent, said that the Board of Health required the septic system would have to be upgraded to Title V requirements, the water supply would have to be re-approved by the D.E.P. and the interior of the building would have to meet Board of Health requirements, fire code and plumbing code. He suggested applicant should meet with the Board of Health as soon as possible. Gail Porciello, Mashpee resident, spoke in the favor of the application and said she had no financial interest in the application. Sam Sirki.s, Mashpee resident, said he was in favor of the restaurant and that a previous restaurant at the site, the Red Top, had been very popular. He also stated that he had no financial interest. Douglas Boyd, Building Inspector, asked the Board to consider the concerns on parking that were raised at a previous hearing on a Special Permit for the property. Mr. Kirrane said he would agree to have some type of curbing installed at the site. Mr. Makunas suggested that the applicant could appear before Design Review to discuss landscaping and egress. Mr. McQuaid askedwhat would be done with the two buildings behind the restaurant and Mr. Kirrane responded that they are only renting the restaurant building. Mr. McQuaid said there has been some illegal dumping between this property and the Chop 'n Block and the Board of Health expected to have this corrected. Mr. Christian stated that the area in front of the restaurant is now used as a passing lane on Route 130 and there was discussion that the applicant can request No Passing signs from the DPW. Mr. Hanrahan moved to grant the Special Permit subject to the satisfactory review by the Design Review Committee. Mr. Friel seconded. All agreed. Patrick Enright (Advisement from March 13, 1991) . Mr. Friel moved to grant the written request to withdraw the application without prejudice. Mr. Govoni seconded. All agreed. Discussion - Charles Talanian, Attorney Donald Siegel and a planner for Chatal Realty Trust asked for discussion of the Wasil Special Permit: for the flea market. Mr. Friel explained that the application was lacking in detail and no plans had been submitted for possible use of tents or appearance of the grounds. The Board suggested that they meet with the Design Review Committee with detailed pians of future proposals.
