r• <br /> MASHPEE SCHOOL COMMITTEE <br /> EXECUTIVE SESSION <br /> JUNE 125 2002 <br /> Minutes <br /> Attendees: Chairman Janice Mills, Peter Thomas, Mollie Deis, Ben Caswell, and DonnaJean Lopez. Also in attendance <br /> were Superintendent of Schools Sherwood Fluery and Business Administrator Michael Tarlw. <br /> Mrs. Mills called the executive session to order at 6:37 p.m. in the Quashnet School Library. <br /> Topics of discussion included the following: <br /> Mr.Fluery's request to be released from his 2002-2003 contract effective September 1,2002. <br /> Motion made by Mrs. Reis, seconded by Mr. Thomas, to approve Mr. Fluery's request to be released <br /> from his 2002-2003 contract effective September 1, 2002 as well as approve a sick buy-back amount of <br /> $5,699.28. <br /> Roll Call Vote: In favor—Mrs. Mills, Mr. Thomas, Mrs. Reis, Mr. Caswell, and Mrs. Lopez;opposed T <br /> none. <br /> Kathie-Lynn Esp sit 's request to extend her unpaid leave ofabsence until the beginning of the 2002- <br /> 2003 school year. <br /> Motion made by Mr.Caswell,seconded by Mr.Thomas,stating the following: <br /> WHEREAS, Kathie-Lynn Esposito has been unable to perform her responsibilities as a teacher in the <br /> Mahpee Public Schools since February 26,2001 due to illness; and <br /> WHEREAS, the Unit A Sick Bank Committee granted Nis. Esposito a total of180 paid sick days from <br /> the Unit A sick bank and declined to grant her additional days from the sick bank;and <br /> WHEREAS, after Nis. Esposito exhausted her personal sick lave and the sick days granted her from the <br /> Unit A sick bank, she was granted a leave of absence without pay under the Family Medical Leave Act <br /> through June 14,2002;and <br /> WHEREAS, Ms. Esposito has informed the administration that she remain unable to perform her <br /> teaching duties at this time but expects to be able to return to work at the start of the 2002-2003 school <br /> year; and <br /> WHERE S, the School Committee has an obligation to balance Ms. E posito's employment interests <br /> against the interests of her students in receiving duality educational instruction from a permanent teacher; <br /> NOW, THEREFORE,R.E, the School Committee rotes to grant Kathie-Lynn Esposito a leave of absence � <br /> without pay beginning on the day on which her leave of absence under the Family Medical Leave Act <br /> expires and ending of the first day ofthe 2002-2003 school year, subject to the following conditions: <br /> x. Nis.Esposito will provide the administration with medical verification of her continuing inability <br /> to work. <br /> . Nis. Esposito will agree in writing in a form satisfactory to counsel for the School Committee <br /> that if she is unable to return to work and perform her teaching responsibilities at the start of the <br /> 2002-2003 school year, she will resign her position as a teacher in the Mashpee Public Schools <br /> and waive all rights to continued employment. <br />
