4 <br /> Board of Selectmen <br /> Minutes <br /> March 5, 2018 <br /> Tribal Housing Developrnent and affordable Housin <br /> Discussion followed with respect to the Tribe's Meetinghouse Road Affordable Housing Development <br /> project. Housing Director Shellie Tobey indicated a total of 42 units are planned at the 5 8 acre site <br /> location consisting of 8 duplexes (16 units), 13 Cape Cod style single family units and 13 ranch style <br /> units. In the initial design 52 units were considered. The Tribe is currently working on tax credits to <br /> develop these important housing units on Tribal land. <br /> It is anticipated the first phase of the project- constructing the duplexes would begin.in .lune for <br /> completion in December of this year. Mashpee Wampanoag Tribal members will be given first <br /> preference for housing. The process would follow with the availability of units by offering the <br /> housing to Native Americans, and then to the general public. It was noted throughout the Indian <br /> country, it is common to mix housing with thegeneral public. <br /> In the second phase of the project which has not been fully determined a community center would be <br /> constructed with a play area for children. Tribal businesses and governmental offices may also be <br /> situated on the property. It is expected the land would remain in Trust for the Tribe to continue with <br /> its land base. <br /> When asked of the Tribe's relationship with the Town of Mashpee as it relates to the Town's <br /> applicability, restriction and/or guidance with respect to development, it was disclosed that Tribal law <br /> adopts the Ma Building Code to standard. There is no legal requirement for the Tribe to adhere to <br /> enforcement of the Torn of Mashpee with respect to regulations, zoning requirements or bylaws. <br /> Therefore, the Tribe is not subject to local property tax, and would issue its own building permits. <br /> There was a question regarding density as it relates to the original 40B permit+ <br /> Meetinghouse Treatment Plant; <br /> From a wastewater planning perspective the Board 'Inquired regarding the potential for the Town to <br /> obtain capacity from the Meetinghouse Treatment plant for nearby areas, In response it was noted the <br /> possibility does exist, however, the project in phase 11 would most likely meet capacity. <br /> Environmental considerations were cited by the Board regarding wastewater flow, and the <br /> regulatory framework for-Title v systems as local and state permitting would not apply to the Tribe. It <br /> was disclosed the Tribal Council intends to develop the treatment plant to expanded capacity with the <br /> regulations that are in place. The project will operate very similar to the process conducted by the <br /> Town of Mashpee and to what is done elsewhere in the country. <br /> It was noted the Cape Cod Commission has adopted regulations in terms of wastewater mandates. <br /> With the development of the 40B project it is believed that a zero nitrogen increase is mandated by the <br /> Cape Cod Commission. This directive will be further reviewed by legal counsel representing the <br /> Tribe. <br />
