AUroval of Minutes: No Minutes were discussed or approved at the meeting on <br /> September 25,2008. Approval will be delayed to next meeting. <br /> 11. Correspondence: <br /> Memo from vice Chairman Gaior dated 9/22/2008 regarding Article 5. <br /> Chairman Sandra Lindsey opened the meeting with a statement regarding her right to vote on <br /> the Assessor's Article for the October Town Meeting. <br /> 111. Renuests for Transfer; None <br /> Iv. old Business: Review of October meeting rrant. <br /> Review of Z nin Articles. &A.with Torn Fudala). Article 17. Tom Fudala responded to <br /> questions, and stated that Article 17 has two purposes. One has to do with the height of <br /> Motels, motels, hospitals,nursing homes, (allows up to three stories, or 45 feet). A special <br /> perrmt is still required regardless of the zoning change. This Article deals with the variances. <br /> The second has to do with the area within the C3 zone, and would allow this specific list of <br /> uses (hotel,motel,hospital, nursing hone, assisted living)to exceed 20,000 square feet. <br /> There was discussion on whether these facilities would need their ovum ori-site wastewater <br /> treatment plant. Mr. Ilenert inquired about building Height, and Bels it contradicts State <br /> Building Code. lir, Fudala confirmed that height is determined by the highest point of the <br /> building(roof ridge), with'a list of exceptions(chimneys, antennas, and other items). Zoning <br /> Code is thea applied. Following the State Building Code avoids arguments and court cases. <br /> Bob Hutchinson had comments and questions with regard to potential changes at Southport. <br /> The definition of"Street"was also discussed, as well as the term"Ancient Way" which is <br /> not a legal,term—it is a road in existence prior to 1846). <br /> Article 18 concerns does being built across marshes. It was believed that the doers were <br /> doing damage to the environment, and a dock permit also required a special permit. Docks <br /> 11/13/2008 1 <br />
