re <br /> WHEREAS Award of aState-issued franchise will in effect eliminate any meaningful <br /> opportunity,for the residents of a City or Towri, such as Mashpec;to address <br /> specific cable related interests and needs that could be provided by any cable <br /> television provider.The Legislation sought by Verizon noYonly prevents fair <br /> compefition .but also limits variety of programming and freedom of content, <br /> and; <br /> WHEREAS Municipalities and their residents have significant and specific inteiests in <br /> thaaerms and conditions attached idthe award of a cabvi <br /> le telesion franchise. <br /> Those considerations should be raised and addressed at the time of <br /> franchising and no emrty is better capable of representing,those concerns and <br /> interests than the Municipality and its residents,through the local hearing <br /> process. <br /> Now, THEREFORE BE IT RESOLVED <br /> that the Mashpee Board'of Selectmen does hereby urge'.the Massachusetts <br /> Legislature,in the strongest possible manner to oppose 'any effort <br /> eliminate the municipal'consent process for'competitive providers of cable <br /> television services,until at a minimum a thorough evaluation'is completed of <br /> the current system and the affect;if any proposed changes'on local <br /> governments,residents, competitors and incumbents is INDEPENDENTLY <br /> analyzed. <br /> Now;THEREFORE BE IT RESOLVED <br /> that the Massachusetts Legislature requests from the Department of <br /> telecommunications and Energy a report on the.status of Verizon <br /> Communication's commitments, operations and intent`to utilize municipal' <br /> rights of way for the purpose of providing cable television service and; <br /> Now;THEREFORE BE IT RESOLVED <br /> that a copy of this resolution shallbe forwarded to Govemor Patrick, <br /> Lieutenant Govemor Murray, Senate,President Murray,House Speaker <br /> DiNIasi, Attorney General Coakley and members of the Telecommunications <br /> Committee and the Barnstable County Asseambly of Delegates. <br /> Theresa M.
