Thompson <br /> Zoning Consultant <br /> MEMORANDUM "t✓� August 14, 2008 <br /> TO: Town of Mashpee -Plan Review O- <br /> RE: Frank Silva, SP-08-37 <br /> I have been hired to assist Gary Beaulieu, Foley Auto Repair,with his case before the Board of <br /> Appeals and on plan review. I am a zoning consultant with an office in Falmouth and have been <br /> operating as such since 1988. <br /> A special permit was issued to Frank and Kimberly Silva in 2004 that allowed for a facility <br /> located at 129 Independence Drive to be used as a contractor's yard for landscaping, wholesale <br /> and indoor and outdoor storage. Six units and an office were approved by the Board of Appeals, <br /> in accordance with the submitted plan, a copy of which is attached. The majority of the property <br /> is zoned Industrial-I and a small portion is zoned Residential-3. <br /> Gary Beaulieu, Foley Auto Repair, leases Unit#5 from Mr. Silva and since June has operated an <br /> automotive repair shop at this location. This use requires a special permit from the Board of <br /> Appeals, which Mr. Beaulieu applied for after learning of the requirement, and the hearing is <br /> now scheduled for September 10'h. <br /> Issues regarding the special permit request were reflected in the minutes of the plan review <br /> meeting when Foley Auto Repair was discussed. The first issue was whether or not the septic <br /> system installed by Frank Silva is adequate for the new use of automotive repair. Attached to <br /> this memorandum is a letter from Jack Landers-Cauley, P.E., which provides an analysis of the <br /> existing sewerage system design for its compliance with Title 5 relative to the use in Unit#5. <br /> The second issue related to existing parking and the adequacy of parking for the proposed use. <br /> The parking design for Mr. Silva contemplated that there would be 4 parking spaces provided for <br /> each unit with an additional 2 handicapped parking spaces provided. Twenty-six parking spaces <br /> are shown on the approved plan. <br /> Mr. Beaulieu's leased space is 2,100 square feet. He has one lift and space for two additional <br /> vehicles within his building, although it is unlikely that Mr. Beaulieu would have more than 2 <br /> vehicles in the building at the same time. There is one overhead door and one pedestrian door in <br /> the front of Unit 45. Mr. Beaulieu is the only employee for this operation, and he has indicated <br /> to me that during the course of a normal day he works on 2 to 3 vehicles. People make appointments <br /> and drop off their vehicles during the day and return later on after the vehicle has been repaired. <br /> P. O.
