Town of Mashpee <br /> e y: 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION MEETING <br /> Mashpee Town Hall —Waquoit Meeting Room <br /> Minutes of the Meeting of April 5, 2018 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel, Chair Mallory Langler, Clerk Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Chair Brian Baumgaertel called the meeting to order at 7:00 PM. <br /> APPOINTMENTS <br /> 7:15 PM -- Public Hearing -- Draft Rental Property Regulation. <br /> Brian Baumgaertel invited the public to express their opinion on the draft Rental Property Regulation. <br /> Leila Botsford, the Executive Director of the Mashpee Housing Authority, introduced herself to the Board. Ms. <br /> Botsford listed some of the concerns of the draft rental property regulation and requested interpretation of the <br /> wording. <br /> Alexander Watt, residing at 129 Pimlico Pond Road, introduced himself to the Board. Mr. Watt had attended a <br /> previous meeting and also forwarded a letter to the Board. Mr. Watt expressed his concern of the $300 fee for <br /> the rental property. Mr. Watt felt the fee is excessive in contrast to the $25 per unit fee for a bed and breakfast. <br /> James Wills, residing at 112 Sampsons Mill Road, introduced himself to the Board. Mr. Wills thanked the <br /> Board for their efforts. Mr. Wills discussed the fee and the record keeping requirements as well as licensing <br /> and possible fines. Mr. Wills felt that a by-law should be established so that the voters can take a position on <br /> the rental regulation. <br /> Ryan Castle, CEO of Cape Cod and Islands Realtors Association, introduced himself to the Board. Mr. Castle <br /> thanked Glen Harrington for taking the time to meet with the members of the Realtors Association at Mashpee <br /> Commons to discuss the regulation. Mr. Castle mentioned the opposition to inspection and registration and <br /> some of the language in the regulation. Mr. Castle made some suggestions to the Board concerning the rental <br /> property regulation. <br /> John Livingston, a resident from Edgewater Road and general manager of Sea Mist Resort, introduced himself <br /> to the Board. Mr. Livingston thanked Glen Harrington for his time explaining the regulation to him. Sea Mist <br /> Resort is a Time Share with some rental units..Sea Mist Resort is in the gray area between a hotel and <br /> condominium. Mr. Livingston commented that the fee is not reasonable and would create a burden. <br /> Richard Halpern, a resident of Mashpee, introduced himself to the Board. Mr. Halpern commented that the <br /> State is drafting a regulation to tax and license Air BNBs, which may be exempted from the rental property <br /> regulation. Mr. Halpern discussed the registration, parking restrictions, fines, and wording of the rental property <br /> regulation. <br /> Tom Ferronte, director of planning and construction for Mashpee Commons, introduced himself to the Board. <br /> Mr. Ferronte reviewed the rental property regulation with Mr. Harrington when the first draft was written but has <br /> not had the opportunity to examine the revised draft. Mashpee Commons is opposed to this regulation <br /> because of affordability. Mr. Ferronte felt this regulation is a duplication of efforts and a duplication of oversight <br /> since other entities are already involved. <br /> 1 <br />
