Draft Rental tol Property Regulation. <br /> Glen Harrington scheduled a public hearing for the Draft Dental Property Regulation to be held on April 5 _ <br /> 2018. M r. Harrington met with the cape cod and Islands Fealty Group at the Chamber of commerce on <br /> Tuesday morning. A discussion was held with about 40 realtors, and they expressed their concern that the fee <br /> would be an issue along with a decrease in housing. The Board of Health offers a service to the public. This <br /> program protects the owner should the tenant damage the property. Mr. Harrington suggested an incentive b <br /> allowed to have property owners register for the remaining sic months of 2018 and extend the permit to <br /> December 2019, allowing six free months. <br /> Mr. Harrington recommended one additional change on the definition of licensed facility. It currently states, <br /> "that any facility licensed under any state or local laws or regulations other than those registered under this <br /> chapter..." Mr. Harrington modified it to read, ``licensed under state or local housing regulations...}} <br /> Alec watt, residing at 129 Pimlico Fond Road, introduced himself to the Board. <br /> As he is approaching retirement, Mr. Watt would like to rent two rooms, a,single unit, of his home. Mr. Watt <br /> suggested for the Board's consideration that there be a classification of the use of the rental properties <br /> because renting a room is different than renting an entire house. <br /> The Board and Mr. Harrington discussed the Soo annual fee and felt it was fair considering that the Health <br /> Department inspects the property prior to the rental. <br /> 4. Draft Nuisance Re ulatlon. <br /> Glen Harrington stated that this draft nuisance regulation was prepared to fulfil the request by Town Counsel <br /> which stated that the use of the Nuisance Law IML chapter 1 1`l Section 122 requires a regulation and cannot <br /> be cited directly from the Law. The Law was used to issue fines for Mast Fitness and 593 Main Street, which <br /> are now considered null and void due the use of the Law without the supporting regulation. <br /> Mr. Harrington researched nuisance regulations and discovered that the towns have nuisance control <br /> regulations but specific to trash, dumpsters, or rodents. This meets the nuisance criteria where there is the <br /> potential spread of disease. <br /> L <br /> The Board and Mr. Harrington discussed the nuisance law for use by the Board of Health directly relating to the <br /> prevention of harm and the prevention of spread of disease. Much of it stems back to diseases spread by ships <br /> coming into ports around the world. Quarantining ships was the basis for all types of quarantines used today. <br /> The Board of Health also has the right to review subdivision plans making certain the ingress and egress of a <br /> proposed residential housing project has clear and maintained roadways, especially for emergency vehicles. <br /> Since there are so many situations where the nuisance law and regulation can be used, Cllr. Harrington <br /> described in a general manner the areas of application with proper support from existing regulations, laws and <br /> bylaws. Mr. Harrington also explained that the Board of Health would issue orders that are not arbitrary and <br /> capricious by stating the existing scientific and medical basis. The orders and regulation will be based upon <br /> known and scientific fact. Mr. Harrington will forward the draft Nuisance Regulation to Town counsel for their <br /> review and comment. <br />
