4 <br /> Finance Committee <br /> Minutes <br /> March 1, 2018 <br /> Review of May 2018 Town Meeting Warrant in preparation for annual <br /> Finance Committee Report: (continued) <br /> Article#20: Petition Article -HELD <br /> To release and extinguish a 120% moderate income restriction on real property <br /> identified as 37 Center Street(Assessors Map 36, Parcel 47D) <br /> A legal opinion has been received from Town Counsel with respect to this regard. If the petition <br /> article was to pass by a 2/3rd's vote at Town Meeting, the vote would be deemed non-binding. <br /> Therefore, it would not compel the Town to lift the restriction associated to the comprehensive <br /> permit. Town Counsel has advised the Board of Selectmen do not have the authority to grant the <br /> relief the applicant is seeking as the matter directly involves the Zoning Board of Appeals and <br /> litigation thereof. <br /> It was noted that three meetings were held with the Zoning Board of Appeals which resulted in <br /> denial. The matter is now in litigation. The attorney representing Ms. McBrien has advised the <br /> petition as a method to avoid court action. Two petition articles were initially proposed to <br /> change the restriction. <br /> Several members of the Finance Committee applauded the efforts of Ms. McBrien who stated if <br /> the article passes at Town Meeting and even if it is non-binding, it is a step in the right direction. <br /> Mr. McKelvey and Mr. McCahill gave verbal support to this article. To maintain a voting <br /> quorum, the Finance Committee agreed to hold their next meeting on Tuesday, February 13, <br /> 2018 to vote on this matter. Mr. McCahill indicated he would be away, but would be available <br /> to participate remotely. <br /> Special Town Meeting Warrant: <br /> Article #1: Snow& Ice Account- Authorization to deficit spend—HELD <br /> The amount to be determined is pending the closure of the winter season. <br /> Article #2: To appropriate $65,000 to the Kids Klub Enterprise Fund Capital Expense <br /> Account for the purpose of making improvements associated with the enterprise, <br /> and to fund the appropriation from the Enterprise Fund of the Kids Klub. <br /> Motion made by Mr. Avis to approve Article 92 as written. <br /> Motion seconded by Mr. Pettengill. <br /> VOTE: Unanimous. 6-0. <br /> Roll Call Vote: <br /> Mr. Richardson,yes Mr. Pettengill,yes Mr. Ryan,yes <br /> Mr. Avis,yes Mr. McKelvey,yes Mr. McCahill,yes <br /> Opposed, none <br />
